So if they removed the $10 smartphone charge without my consent, isn't that a breach of contract that can allow me to terminate my contract with them?

Lol no. But I'm sure they'll put the 10 dollar fee back on if its that big of an issue.

It does not take a lawyer to tell you the answer is 'no' - An element of a breach of contract claim is damages.

But the $10 could've gone to my FSA and now I'm screwed because of medical expenses I did not save for beforehand. That $10 tax deduction is a lot man.... :D

They are reducing your bill and you are complaining ? ? As long as you still get the same data service, be happy. Now if they decide to add a new fee without informing you first, usually in the very small fine print on your bill, then you might have a case.

He's not complaining, he's looking for an excuse to get out of his contract to either get a new subsidized phone or change carriers.

Yes, but removing a fee is not a reason to be able to break a contract.
If they added a fee without advising him, that would be a reason to break a contract.
