You shouldn't have left the store with it messed up...good luck proving it's their fault :(

Just take it back and calmly explain that since it was serviced, it keeps popping apart. Don't mention that it's been "open" ever since you walked out the door with it.

What he said. In a store you have a chance of getting them to back down because you're there in person. By mail, not a hope in hell.

well, after about 20 minutes of fiddling with it i was able to snap it back into place so it doesn't look like its even been open. do i still have no chance of getting it fixed or replaced (by mail)? i'm really not able to go back to the store within the next few weeks (at least) and if there's any chance at all they'll replace or fix it by mail, i'd much rather do that.

edit: i'm thinking about giving it a shot through the mail, since Apple pays for shipping and handling, I'm thinking it'd be worth it to try it first, then if they mail it back take it to the Apple store?

Dude, I've dealt with Apple's mail in service before, its USELESS. I sent my iPod in because the hold switch was acting stupid, it would only work every other try or so. Well, they sent my iPod back, still broken, and scratched like it'd been thrown around in a silverware drawer. Take it to the store and tell them its been coming open since you took it there. I went there with my iPod because it got obliterated by Apple when it was mailed in and because the hold switch was still broken, they replaced it on the spot.

EDIT: ALSO! Opening your iPod does NOT void Apple's warranty, FYI.

so i requested service and sent it in to them, and since it was a dead unit, they're sending me a new iPod :D it cost $30 for S&H since it was older than 6 months old (bought it last September), but to me its worth it to get a new iPod ;)
