if a cop is going the opposite direction as you... (speeding ticket)

can he still accurately use his radar gun to get your speed? When I'm in court, how do i tell this to the prosecutor without sounding like I'm blaming it all on the cop or something? do i get a chance to just describe the situation? Thanks!

Yes, he can. And don't worry, if you say that it won't sound like you blame the cop, it will sound like you blame yourself for speeding, which you were no doubt doing :p

one of the worst things to do is "doubt" the officers ability to use his radar gun, in a court.

a friend of mine did it, they questioned the officer. The judge asked the officer of his training.
the judge always believes the officer.

you need to have something more substantial than to question the officer's training if you want a hope of winning.

The only way I have heard of people getting off tickets, is if the radar was done from the air or if it has been a long time since the radar gun was calibrated.

Ok, so he was going the opposite direction as you, gunned you, and found you were speeding. You obviously indeed were speeding or you wouldn't come here asking how to get out of it, because you would just go to the judge pleading your case. The only ticket I got from a cop, we were going around a curve, opposite directions. I was going fast around the curve (60 in a 40), he flew right past me and my radar detector flashed for a split second. Ill be damned if he didn't give me a ticket for 60 in a 40. Those guns are accurate, no matter what direction your going.

Was the radar gun mounted to the vehicle? If it was, then it was probably tied into the cop's seedometer.

From what I have heard from police (this was a few years ago), radar can get you in any direction if the radar gun (car) is stationary. They can only clock you while driving if they are coming toward you or at some angle. However, if they are driving behind you, radar will not work. Laser and/or upgraded radar may have fixed this problem, so I wouldn't count on it.

IMHO, different radar guns have different capabilities. This may not apply to all radar guns out there, so don't get your hopes up.

take it to court and fight it... I just took my ticket to court and it was dismissed even before I had to argue it because one of the officers quit the force.

Also, you can state things like you were right next to a car (if you were) and the radar hit the car next to you.. if you are in close proximity to another car, the ticket can get thrown out. Also, do the pre-court stuff and request the calibration information for that radar gun.

When I was in court, the just made a little 'speech' before any of our cases were heard.. he said if it was a radar case, he would not change the ruling unless the pre-court material was filed.

That is because the officer either didn't feel like showing up or he left the force on bad terms. I have seen officers appear in court after leaving the force and still win the case.

With radar guns there are many different kinds, and whatnot, I'm sure you all know. Anyhow, atleast with the air, they are likely using lasers, in which, basically if they want your arse, they have it. Lasers are starting to be used more often now as far as I can tell, but anyhow it is my personal opinion, that they might have let you slide before, but at this time of year they are looking to make their quota- although any officer would shoot that down so you arn't going to get off easily. As for experience, I have known people to get out of tickets easily just by not having their licence with them, because I think it means that there is a bit of paper work for the officer to fill out if they still give them a ticket, but I'm not certain on that.

If the cop was going the other way, then he used a dash-mounted doppler radar system, not a standard radar gun. They are very nifty little setups and yes, they are tied to the cruiser's speedometer. They are every bit as accurate as regular radar guns.

But wouldn't you then get a ticket for speeding plus one for not having your license?

Sign up with NMA, read all you can about fighting tickets and use the flaws in the radar guns to win your case. In my state, cops don't need to show up, they just need a representative. I've won 2 against radar and one against lidar. However, it depends on how sound your story is and what speed you got nailed at. Remember, radar is a lot of flaws....and yes I am an NMA member.
