A deportation officer with US Immigration and Customs Enforcement (ICE) was arrested on multiple counts of sodomy last week, according to an Oregon State Police news release.
Blake V. Northway, 55, was arrested Thursday after a joint investigation between state police and ICE's Office of Professional Responsibility. He was charged with 10 counts of sodomy and one count of incest, according to online records with the Jackson County Sheriff's Office. Northway is being held on $1 million bail at the Jackson County Jail, according to those online records.
Northway's charges are not related to his position with ICE, state police said. The release from state police did not give any details of the alleged offenses.

Northway was assigned to ICE's Medford office, in southern Oregon. Tanya Roman, ICE spokeswoman, was quoted in the state police news release as saying the agency holds "its officers to the highest standards of professional conduct and does not tolerate those who violate the law." "ICE will continue to cooperate until this case has been resolved," Roman said. Northway has been relieved of all ICE authority and placed on leave pending the results of the criminal investigation, state police said. It is not clear if Northway has obtained an attorney. CNN efforts to reach Northway were unsuccessful.

Yes please. What kind of sodomy. Who with. Consentual or not. While in uniform or while off.

After further reading it appears that the charges are from 2009 and since there's incest in there, *probably* means he assaulted a relative. This means that his employment is likely not a factor, so the headline is "man rapes daughter" and not "evil ICE tyrant abuses power, ICE bad".

So maybe it was forcible sodomy but why wouldn't he just be charged with rape?

BTW that is a piss poor reason to keep sodomy laws on the books. It would take virtually no time at all to write a separate bill outlawing aggravated sodomy or just include it in the rape statute where it, imho, belongs.

Edit: I just looked up Louisiana's rape statute and it does include anal rape so I'm not sure what they are talking about unless it's just an additional charge they can throw at them?

Laws which are declared unconstitutional remain on the books until repealed. They are, however, unenforceable.

Which is why this case is strange.

Since 2003 10 men have been arrested in Baton Rouge stings. Basically, the cops would target gay men, ask them if they wanted to hook up and then arrest them for crimes against nature. In 2015 two men were charged with crimes against nature, they were having sex in a car though but were still charged with it. The charges in the 2015 case were dropped and they only caught a trespassing charge, not sure of the earlier ones. I'd wager that their bail was substantially higher because of the added felony at the very least.

As I understand it, as long as the law is on the books they can still arrest, charge you and bring you to trial. It would probably be a very short trial but you'd still incur all of the expenses. Heck a retarded judge could probably deny the motion to dismiss and you could be found guilty and you'd have to take it to a higher court to get it overturned.

Yes that is all true. Except in the ordinary case where laws are held unconstitutional, they tend to be repealed. Not these. This is the religious right refusing to give up on the chance to punish people for their private sexual behavior. It must give them comfort knowing the laws are still on the books and they can at least continue to harass people with them.
