Just got back from court. Some renters who we were in the process of evicting for not paying rent for months got themselves a lawyer who filed a stay order with the county court. The order forced us to stop eviction proceedings.
We had our appeal hearing today. The judge ordered the scummers to pay the full amount they owe within 45 days and to be out of our building by February 18th.
The renter's lawyer screwed them over horrifically. They'd have been able to stay in our apartment for months (literally) had the lawyer not filed this action. We'd have had to file numerous motions at the Magistrate and wait for months to have Constables remove them from the apartment. In order to get the money they owe us, we'd have to execute a sheriff's sale. They could have claimed "no possessions" and we'd have to file a lien against them.
Quite frankly, we'd have never seen a dime. That's how magisterial court works.
If the renters don't comply with the judges order to make payment and vacate, we simply file a complaint and a contempt hearing is set. A Bench Warrant is issued and they go to jail until they make payment.
This process cost me $0.00. If they hadn't gotten a beligerant fat ugly bitch retarded lawyer it would have cost me on the order of $3,000 in lost rent and Magistrate fees that I'd never recover.

Nice job. My mom went through a similar situation with people who were squatting in our old house not paying the rent. Much more difficult to get the scumbags out of the house. It pisses me off that people can just go house to house doing this and get away with it. There is not much you can do except go through the legal system for months while the people trash your house. :|

Why am I not surprised then that she didn't pay her rent? Did you do any real interviewing of people interested in the place, or did you just pick the first person that wanted it?

Perhaps the lawyer figured she had a fat chance of getting paid and did what was in her best interest to end the situation quickest so she could move on to other things... oh wait, that wouldn't be ethical. Well, perhaps she told them the options about dragging it out and her fees, etc.

My argument is shot to hell if the lawyer is provided free of charge to the squatters.

BTW, Is this in Canada or somewhere else? It doesn't sound like US from the terms, but, I'm not sure.

The lawyer stepped on the judge's toes and he let her know it. "Ma'am, I work closely with your office and we don't customarily handle these situations in this manner. You are not the normal representative from your office. Where is so-and-so".
To which she replied "I am handling this case".
The look on his face was worth the trip.
The judge then vacated chambers so the lawyer and I could strike a deal. She approaches me for my records which I give her and says "I don't understand why Ryan's name is on this lease if he had moved, etc., etc., etc.". I began to answer and she immediately interupted me.
I then replied, "I'd be happy to answer your question if you'd please stop stepping on me".
Her reply was, "When you are willing to talk civally, I'll be over at my table. You can come over there and speak to me."
To which I replied, "We've completed our negotiation".
The judge had already told us what his ruling would be and gave her opportunity to talk numbers. I'd have settled for twice the time and half the money just to get them out of my place.

We rented the apartment to her SO and one of his buddies. They both passed references and history check. Both have decent jobs and their employers spoke highly of their work ethic. Scumbag chick rolls in, buddy rolls out. Stupid guy is left taking care of scummer chick and her illegitimate children. He decides to stop paying rent, likely at her coaching. The girls at CYS and Salvation Army tell me said scummer bitch's life story. She's 3rd generation welfare. Good at it, too.

Be careful. There was an article in the NYT real estate section a few weeks ago about just this sort of thing. Of course, the laws may be different where you are but basically, after a judge granted the eviction and set a date, the deadbeats were able to file for bankruptcy the day before the sheriff was to execute the eviction. In NYC, you cannot be evicted after filing for Bankruptcy protection. They were able to postpone their inevitable eviction 4 times by declaring bankruptcy in the Male and then Females name. Then they declared bankruptcy under a false name associated with the address and finally were able to secure another delay due to NYC not executing evictions in the last week of December.

I guess the moral of the story is to call referrerals and most importantly obtain a credit report on future tenants. Good luck.

that is when you go find "some guys" pay them a grand or so in cash and have them go over one night with ski mask on and baseball bats to get the message across to them.

That won't help you here in Ontario Canada. Once the eviction proceedure starts and the eviction notice is handed to you by the Sheriff's office, you have 7 days to vacate the premises or you will be arrested and any or all of you belongings will become the Landlord's.
