Just got back from court. Some renters who we were in the process of evicting for not paying rent for months got themselves a lawyer who filed a stay order with the county court. The order forced us to stop eviction proceedings.
We had our appeal hearing today. The judge ordered the scummers to pay the full amount they owe within 45 days and to be out of our building by February 18th.
The renter's lawyer screwed them over horrifically. They'd have been able to stay in our apartment for months (literally) had the lawyer not filed this action. We'd have had to file numerous motions at the Magistrate and wait for months to have Constables remove them from the apartment. In order to get the money they owe us, we'd have to execute a sheriff's sale. They could have claimed "no possessions" and we'd have to file a lien against them.
Quite frankly, we'd have never seen a dime. That's how magisterial court works.
If the renters don't comply with the judges order to make payment and vacate, we simply file a complaint and a contempt hearing is set. A Bench Warrant is issued and they go to jail until they make payment.
This process cost me $0.00. If they hadn't gotten a beligerant fat ugly bitch retarded lawyer it would have cost me on the order of $3,000 in lost rent and Magistrate fees that I'd never recover.
