Take her to court. She deserves to have her credit, her finances and her life ruined by you, considering she was driving without insurance and TOTALLED your car.

Sorry to hear that, but I'm sure a laywer would be happy to help you out, considering you have a medical claim too.

Take her to court and bury her.

That sounds like the thing to do, but it's hard to get water from a rock...

My thoughts exactly. I'd much rather get water from an insurance company with big cushy accounts.....it'd probably be bottled spring water rather than the rusty sulfer water I'd probably recover from this chick. I just know that this is going to end up costing me more money in the end than anything. That's what truly bothers me. I'm 23 and now have tingling up and down my legs and arms because of this accident. That's a sucky feeling to think that I'm no longer invincible. I wish I could do something about this that would at least result in me getting a comparable vehicle and getting full reimbursement for my medical bills and some extra money for the trouble.

Hell, my parents had to evict a tenant from their rental property about two years ago because he just stopped paying rent. He was able to live in the house (rent free! :|) while the case went through the courts and everything.

It was infuriating for them, but the court has finally started garnishing the former tenant's wages, and my parents get checks for about $700 a month now. He owes us about $10,000, so we'll be getting his checks for quite a while.

It's nice to know that my parents are continually raping this asshole, well after he scammed us out of our money.

It's amazing what types of protection tenants have when they are getting evicted. Glad to hear that your folk are getting something out of the lowlife and the system does work alittle.

Also, what should I try to get from this situation? I know my jeep is going to be under-appraised and I'm going to have a hard time replacing it. My neck, back, abs, and left leg are all sore. I've never been in a wreck like this before....especially one where I was legally parked on the side of the street. Advice please. Thanks,
Medical expenses, lost wages, as well as the car coverage.
That's a given, but I was thinking about pain and suffering, and trouble for this inconvenience... I didn't know what kind of dollar figure you can put on that.

Sorry, I am not sue happy. I have been in a couple of wrecks that were not my fault. I never asked for pain and suffering. Just my car, medical and lost wages.

So what? Just because you did not seek those damages does not mean the the OP is not entitled to receive them.

It's sick - it really is. The guy just stopped paying rent, and he lived in the house for about 4 months while eviction proceedings were going on. I guess it's meant to protect tenants from evil scum landlords, but landlords receive almost zero protection.

Yikes uninsured crash. I got hit back in September by one of these no insurance bastard. I let my insurance handle it, they gave me a nice list of things to do. My insurance (AAA) paided up promptly, and then turned around and sued the other driver for losses. I made sure I filed that accident report with the DMV to show that the b!tch didn't have insurance.

And now no one wants to insure me on the cheap, I lose in the end.

wtf she doesn't have insurance? I wouldn't say ruin her life but get your money back and medical treatment taken care of...actually that probably will ruin her because the bills are so much. I f$$$$$ hate dumb b$$hes with no f$$ing insurance. Why is it always the dumb fu4$ks that get in car accidents are the ones that are uinsured? Probably because they either got their insurance taken away for already being an idiot, don't have a license because they are an idiot, or they are an idiot on other levels.

F$$k this dumb f$$$$$wise and beautiful woman. I have a 94 jeep cherokee sport and I love that thing. If someone hit it I would be enfuriated.

No but you can get gravel :)

It's not your fault that she ran into you and she also didn't have
any insurance. She should have at least received a ticket on the
accident scene for that along with other charges.

I would get a lawyer and get at least the total value of your jeep and your medical expenses
and lost time dealing with this and lawyer fees out of her.

I spoke with my cousin's wife today. (she's an attorney) She told me that to get anything out of the chick would probably take too long. Her advise was to file with my insurance company under the uninsured motorist insurance and not bother with a lawsuit because the appraisals on the property damages would probably be the same whether I'm in court or not.

As far as the medical expenses go, they will be covered between my health insurance and car insurance and there shouldn't be anything left uncovered. As far as anything else, my only other claims would be neglegence by the driver or claims for pain and suffering. I don't know if either of those can be proven so it's almost not worth the risk of losing or even waiting on this girl to pay. Blah....I hate this crap.
