Ok... I guess you can somehow prove that the accident was partially due to her negligence too. But I don't see how he can get out being at fault.

That's what I've been hearing multiple times, that technically it's my fault, but it still pisses me off - if she wasn't speeding that fvcking fast or actually paying attention, then this wouldn't have happened!

Yeah, the guys I talked to handled thousands of cases like this - basically, the best case scenario is that she'd get a light slap on the wrist, but the majority of the fault would lie with me. Fvcking pisses me off.
Why are you throwing the word "technically" around? It was your fault, very cut and dry. Trying to place the blame elsewhere is stupid.
If you didn't take that left hand turn, then it wouldn't have happened. If you weren't at that intersection it wouldn't have happened. if if if if if

If someone cuts you off and you rearend them, it's still your fault even though they made the dumb move.

How the fvck was it my fault? She ran into me while speeding! If she had obeyed the speeding law even, she very well could have stopped herself!

i had an idiot like you demolish my fvcking car when i was in high school. i was driving straight, he was making a left and "thought the coast was clear" and caused $3000 worth of damage to my car. of course my friend's body shop estimated the damage at $4500 and my car came back in better shape than ever, but i still think that guy was a complete idiot.

So Jehovah just had bad luck. You're guilty of felony Insurance Fraud. Mind giving me your name, number, Insurance Company, and Claim number?

You crossed the line of traffic with the right of way and a person with the right of way hit you, therefore your fault.

The bottom line (REGARDLESS OF WHETHER OR NOT SHE WAS SPEEDING) is that you obviously didn't time the turn well. If you had (REGARDLESS OF WHETHER OR NOT SHE WAS SPEEDING) you would've made it through the intersection.

Did you have a green light or a green arrow? If you had an arrow, then her side would still have a red light and then she would be at fault. If it was just a green, then you should have been more careful and are screwed.

But why is it her responsibility to stop? She had the right of way. It was your duty to yield to her, even if she was speeding. It doesn't matter if it was empty for an hour. Clearly it wasn't empty when you crossed it. Either your reaction or your car is really slow.

How the hell is this not your fault? I don't understand. You misjudged traffic, and moved out to cross trafic when you shouldn't have.

You said there was a hill 100 yards away right? There is no way there was a blind hill 100 yards from a stop light. IIRC the minimum is well over 500. But lets assume you are a good judge of distance (which obviously you are not, but hey.) Lets do some math. The maximum grade is 6% for intersections. Assuming this was a real small truck, lets say 6' tall. At maximum grade, the oncoming car would have been visible for 400 feet by your own admission.

At 40 MPH , it would have taken the oncoming car just over 8 seconds to go from that hill to the intersection. 8 seconds is forever. You could get out of your truck, and run across the intersection in 8 seconds

At 80 MPH (double a normal speed limit), it would have taken just over 4 seconds for the truck to get to you. 4 seconds would be a break in traffic of nearly 200 feet at 40 mph. 200 feet! Even at 80, you could have made the turn with room to spare.

At 160 MPH, You would have had about 1.6 seconds to get out of the intersection. Normal reaction is about 1/2 a second, so that would have given you 1.1 seconds to accelerate into the intersection. In a normal car, this would be about 10 feet, so you would have gotten nailed in the passenger door, not the front corner.

Conclusions:
The other driver was doing well over 160 MPH, and is employed by the Earnhardt family. (I doubt it, you would be dead and I wouldn't have had to bust out my slide rule.)

You can not judge distance, and after your post here, should never be allowed within 100 feet of another car. The only problem is we would have to give you a tape measure so you know what 100 feet is.

Listen, I'm a little upset since this happened about an hour ago; it's my fault even though she was the one that made the dumb move, and I have to cover it. I have no way of transport for god knows how long, I live ten minutes away from campus, and I am broke as it is.

I'm here to vent because I'm not exactly in the mood to talk to someone face to face right now. My roommate was empathetic enough to ask if that girl was cute when I told him this. Is that okay?

okay i have 2 questions ...

1.) you say there were no witnesses, yet you mention "there were a few other cars in the middle lane on the opposite side" which means that there were OBVIOUSLY witnesses there to see what happened, so why are you claiming no witnesses.

2.) why the hell did you wait the whole 2 seconds with a clear left side of the road for 2 seconds before deciding to turn? maybe if you turned when you FIRST saw there were no cars coming, then 2 seconds later you would have been through the intersection.

go back to driving school ...
