OP, I strongly urge you to keep your eye on who was at fault, and not who can pay. Money isn't going to bring your dad back, nor will it stop this from happening to someone else.

Believe me, I know the sad state of affairs of the legal industry first hand as I deal with litigious plaintiffs on a daily basis. However, even though I may not agree with it, it would be prudent for OP to evaluate all his options.

Hmmmmm. Sit around in a court for a year to a year and a half while paying an attorney out of pocket with a strong chance you'll loose the case being that it's against the state and law enforcement will likely *NOT* be found reckless unless you have undeniable proof ....

.... or take a settlement from a multi-billion dollar agency. Tough choice.

You'll know pretty early on in the litigation if the government agency plans on settling or not...and most PI attorneys work on contingency so there will be no out of pocket $.


I understand the anti-lawsuit sentiment in this thread -- I share the sentiment -- but a lot of comments are being made without any real understanding of the litigation process.

The reason you were offered 50k is because that is probable all the insurance he has. He probable has a 50/100 policy. If you want to sue you can but if they have little to no real valuables then it would be watsed and the 50k would get eaten by lawyers.

Think OJ. The Goldmans have a judgement against him but can;t collect as everything he had was sold.

The only legal advice you need is "Go talk to a lawyer."

Amen to that, if this happened in Texas you'll need a lawyer who is licensed to practice there. Also, be careful that said lawyer is actually independent of the cops, the insurance companies, and the driver.

In some cases insurance companies have been made to pay more than the insured amount (here it looks like $50,000).

You will likely have lawyers beating down your door within a week of such an event.
