I know some of you know the law pretty well; lawyers, judges, policy officers etc....some of u guys have to be in the forum! anyways, here is the thing, i got a parking ticket ($275), and well to be honest, i really did do it <duh>. Now heres my question, does a ticket have to be 100% accurate to be valid, and when i mean accurate, right down to the time? Heres the scenario, 4 other cars were ticketed, it was @ 9:30pm when we all got cited. On all our tickets it says 2130 in the time column.....but the thing is, there is no possible way a cop can write 4 tickets all within a 1 minute time frame (getting all our license plates, writing in the vc #, even writing in a no front license plate citation). Now obviously im sounding really stupid, but im hoping there is a law that requires a ticket to be 100% accurate, or it can be ruled out. Pls, if any1 could inform me on my situation....HELP! i dont want to pay that much money!!!!

Is this a ticket that was written out? Or is it one of those computerized ticketing
systems? Written out I don't think it could be done in one minute, but if they have those
computer ticketing things they could easily make a ticket in 15 seconds just by typing in the license/vin.

i am pretty sure you don't have a case. there are laws protecting cops that unless there are some major errors with the ticket, the tickets are still valid. we are talking about getting your whole name wrong, your car brand name wrong, etc etc.... even if a cops pull you over but he misses a "h" in your name that ticket is still valid. so in that case no way you can get out of the ticket. judges won't buy the 2130 story.

but still, sorry to hear it.... :(

You're screwed man. Cops are allowed to round the time. As long as he didn't write it with the time being 12 hours away from when you parked he's going to win.

Well i know it isnt much of a case(if any) but i also remember hearing something about a certain time frame. I was "PARKED" for about 30minutes, but isnt there some sort of a classification rule to be considered illegal...i remember they applied a rule to some ppl that parked in a parking lot, illegally, for about 15 minutes, soon enough their car got towed. I know, i know, im just rambling and its irrelavant to my situation, but at the same time, this really puts a damper on my wallet.

And even if i decide to take this to court, in order to do so i have to write a letter. If i want to take it to court, should my letter even consist of admitting guilt? One of the guys said he was just gonna write a letter and say he was really really sorry, but that would be used against him in a hearing. So my question is, should i just say i didnt park there and hope the cop doesnt show up? what should i do?!?!

I hate to tell you this.. but I don't believe that you have a case. I had a similar situation before.. but in my case it's speeding. Like you I thought that the ticket have to be exactly accurate and I got pulled over for driving 85mph but at that time when he was pulling me over I was on a ramp so I thought there is no way I was going 85 on a ramp that curve around to switch to another freeway. I knew I was speeding but not at 85. So I figure I'd go to the court and prove to judge that there is no way I was going 85mph. Well.. I proved that there is no way I could go 85 MPH but I did tell him that I was driving around 70 thinking that the cops usually give you a +5mph on the max speed limit so the judge would be lienet on it.. I was wrong.. he said I was still speeding.. so I lost the case :(

You have no case, it's as simple as that. Maybe if you could find some high-speed defense lawyer that would cost you about the same as the cost of that ticket per hour could you get out of it, but even then, fact of the matter is, you were wrong, even if it's only for a few minutes. Murders are usually wrong only for a few minutes too, should they get off everytime just because someone is a few minutes off on the time the murder occurred? I know it's a stretch of an arguement, but that's the way to look at it too.

Oh, I missed your last post before mine. In my opinion, you can't argue with the officer about the time or anything else. Your only recourse in my opinion is to be honest, admit you were wrong and hope for leniency. Don't try to patronize a judge though, that will get you bad karma real quick. You can always write up your statement and attach a "Get out of jail free" card from Monopoly to it and hope for the best!

Your only other hope is digging up a squirrelly rule about marking fines. There was a thing here in Pittsburgh where the law stated that in order to ticket someone parked in a handicapped spot you had to have the fine clearly marked along with the designation of the space. Some guy was able to get out of a ticket because he was able to dig this up, and as it happened the space he had parked in was not properly marked. There are always these kind of loopholes out there, but it depends on how much time you have to invest in finding them, versus paying the fine. $275 is pretty steep for a parking fine, but I guess it gets the point across.

Go to court, plead innocent and hope the DA gives you 50% off the fine to get you to drop the right to a trial.

lol. youre mad at the cop for writing you a ticket cuz you were parked illegally in a handicapped space and think it's cuz of his quota?? now if he gave you a ticket parked in a regular parking space.. just pay up and move on..
