Yes and no. The Justice Department is part of the Executive Branch, but operates independently. Sort of. They don't answer to the President as such, but the Attorney General is appointed by the President as part of his Cabinet. Do the math. Hilary managed to stay out of jail because Bill and Barack ordered their DOJs on what to pursue and what not to pursue.

But when it all turns into the farce that it is they'll act as if the "investigation" never happened just like the Benghazi where all the Repubs wanted was to drive down Hillary's approval numbers for her run at the presidency. That contrived ploy worked marvelously for the Repubs, facts and the truth be damned.

The Repubs have developed and have mastered the art of burying the facts of a matter under tons of bullshit so much so that in most cases, separating the gold nuggets buried in the shit becomes an act of futility which is exactly what the Repubs intentions are. They've managed to make bullshit more attractive and palatable than any which way a prime ribeye could be dished up and most of their constituency just digs into that crap like it really is the real deal.
