I haven't been paid in 9 weeks...

I am contracted through a relatively large company and send in bi-weekly invoices. The last time I received a payment was for the first two weeks of November 🙁 I have no legal contract with them so I'm assuming there is nothing I can do immediatley. I continue to call and email and what not, but still to no avail. What time has to pass before this becomes illegal to do. I am struggling living off of no income 🙁

Um, go to the company and demand your paycheck. Refuse to work without it, b/c quite frankly you're working for free right now (I don't know what the laws state about being paid for hours you worked and such, but you might want to check it out)

Well, the first thing you should do is stop working for them until you receive payment.

As for time... I'm pretty sure enough time has already gone by. I assume that they paid you in the past, so that does set up a precedent, although it would have been a lot better to have in writing.

Call the company and inform them of the situation and why you can no longer work for them if they are going to insist on not paying you. If they still insist on withholding payment, contact an attorney. You might have to sue them in court.

Sorry to hear, man. Next time, remember... always get it in writing. Hell, I don't work for a place as a regular W-2 employee without some type of contract.

some people would install assurances just in case they get screwed, like you are, but you don't know it yet.
Guess what? They are "out of money" and are stringing on anyone who will let them.

Stop working now! Demand your money.

If you are doing software work for them, demand either your money now or YOUR code back.

If you're in Cali you got 4 years from the last time they payed you (contractual statute of limitations) to file suit. But you're in Virginia so I don't know.

Are you actually an employee or a contractor? Are you doing work for them directly, or for a third-party client?

Do you know if other people in your situation are being paid?
