I have never been in this situation before and need advice on what to do.

I traded a video card for cash and a 7500 aiw. The AIW was to be in working condition all items there but the remote.
When I recieved the card and was taking everything out of the box it had a cap in a sandwich baggie and upon looking at the card saw where it would of gone.
I contaced the buyer right away of this issue. He said he was unaware of the cap missing and I provided him with pictures of the card and cap in the baggie. I explaied that I wasnt going to test the card for it was missing the cap and dint want to take the chance of it messing up my system I needed and was planning on selling at the time and had pics of everything.

Upon seeing them he right away sent the money to replace the cards value and sent me $5 to ship it back. It was all great and I was happy. He was going to be gone for a week and asked to hold it till he got back and then ship it which I did the day after he contacted me.

Now its been like 3 weeks and the card has not arrived but I have shipped it out and I have never had a package get lost before. Granted slow but never this long or slow to get to where it is coming. I also never had one come back to me because I wrote the wrong addy on it. So what would be right thing to do. If I am having to buy the card for what was advertised which was a non defective working card without missing a cap I would have to pay $40 but the card diod show up missing a cap and I refused to test it out of fear it would mes my system up and if I have to buy the card (because it got lost) then I dont see how $40 would be fair for a broken card that was advertised as perfectly working but did show up broken not as advertised or told.

I aslo want to work this out right because they guy did replace the value very quickly and everything went smothly but now that it is lost and I have to buy it it didnt exactly show up as advertised for $40.

traded card for money and "working" 7500 aiw
Card shows up not as advertised missing cap which was in baggie
Buyer replaced card value with money right away and paid $5 to have shipped back
Lost in mail or hasn't shown up yet in 3 weeks and will have to work something out
Buyer wanted $40 for a "working card" with no issues but not how it showed up
Dont think I should pay $40 for broken card that got lost when it wasnt advertised as such
What to do and what would be fair?

The cap probably came off in the original shipping. Suck it up and pay him the $40, it's the right thing to do. (Sorry, but Karma will make it up to you later)

So the cap came off stuck itself it a ziplock baggie and put itself back into the box ontop of the graphics card while being shipped to me?

I asked if he knew and said he didnt know and tested the card himself before shipping. But the cap was laying ontop of the card when I was removing everything. How do you test the card but not know of a cap that had to be laid into the box ontop the card when shipping it out?

I missed the part where you're suppose to ship it Priority Mail + free delivery confirmation using Click N Ship through USPS.com? What method did you use to ship the the card back?

Sorry, missed that, thought the whole card was in the bag and you found the cap when removing it. Weird, he actually sent it to you that way (it is possible if it was packed poorly that somehow the post office did that)

It went regular mail and I had to pop in a few bucks as well since the $5 didnt cover it all. And no I stupidly didnt keep the reciept for I have never had a problem in all the years I been doing this stuff online.

Again I dont mind paying for the card one bit jsut not really looking to "buy" the card at $40 since it showed up not as advertised and I couldnt test it out. Said he tested the card and didnt know about the cap when the cap was in a bag laying ontop of the card when I got it so how could he of tested it and not of known about the cap? How do I know it was really tested and was actually working even though it was missing a cap?

Many times a card will work with out one or more caps, because the systems are redundant. Next time don't be so afraid to test it either, there's absolutley no way a missing cap could fry anything else but the card itself, and even that is unlikley. But if he knew that the card worked without the cap, then why would he ship it with the cap in abggie. I think the most plausible explanation is that the cap fell off in shipping (like the mailman dropped it, or dropped something on it and the card somehow came out of the package), and he put the cap in a baggie, and closed the package back up.

That right there makes it your responsibility to pay him. Regardless as to whether or not the card worked, he agreed to refund you and take the card back, you needed to make sure it got to him. Even if the card is broken, chances are he could get it fixed under warranty, or sell it to someone who could fix the cap on it for a few bucks less. Confirmation is a MUST, insurance on anything over $50 is highly recommended. Since you can't prove where it is, that you shipped it, and you now can't put a trace/claim on it, you need to pay him.
