you could post negative feedback. i will do worse. after winning the auction
i emailed and someone replied me that i indeed did not win the auction at
260.01. because someone else had it for higher(275.00$). you know as well as
me that if you conatct ebay and i will reply that you refused to sell me the
phone becuase you felt the amount was too low and probably could of sold it
for more(wich in these circumstances an a530 is worth more). who do you
thinck they will believe it will be obvious that the guy you wanted to sell
it descided not to pay. you should let this go. because we will have to send
this e-mail everytime we want to buy something or sell it.

First of all, where do you get off threatening this guy to leave negative feedback? So he hasn't responded to the auction that he won, it's only been 4 days! If I got a nasty email like that for no reason I'd sure as hell be pissed.

You should have waited at least a week before even attempting to get all nasty.

Oh, I have no idea what the hell he's talkin about, it sounds like he is confused.

Agreed. Maybe I just overlooked it but I don't see it posted where you specify the time the user has to pay up. I always specify that the winner has 72 hours to send payment or else. But as for this guy, he's a idiot. Take him down. Took me about 5 minutes of rereading what he wrote before I was finally able to "understand" it. Get em!

If that's not the case, have him email you full headers of the email he got. He won't be able to, and ebay will ignore him when he can't prove you told him he didn't win it.
 
Yeah, big thumbs down on the "threat" sent. Might have gotten a much different response with a more civil, no-nonsense "tone".

That being said, yeah, I think his retaliation threat is absurd. He's saying he'll claim that you refused to sell to him at his winning bid price because it was "too low" and you had gotten a better offer. He's smoking crack.

well i sold two other big ticket items the same night and got full payment via paypal IMMEDIATELY after those auctions ended, so perhaps i was a tad bit spoiled by that.
but the bigger issue was that the guy was completely unresponsive to numerous emails/invoices that i sent him. after about 8 emails which get NO response, i think i'm entitled to send a terse: "you have 24 hours" type email.

Getting paypal immediately is great, but not near what is required. You're basically required to make contact within 72 hours or so.

You sent 8 emails in 3-4 days? Dear lord, that would drive me nuts. Some people aren't on their computers 24-7, you know. Granted, it doesn't sound like this guy is a stand up fellow, but come on.

anyway, i definitely want to get this guy as best i can but what can i do to guard myself in the process? shouldnt he be prohibited from leaving feedback since he technically never purchased my item? i mean, HE'S the bad guy, right???

i figure what ill do is wait three more days and file a non-bidding payer alert... i guess once that's done he will no longer have the right/ability to leave feedback for me?

I disagree, this is eBay, not the AT FS/FT forums. You are not always going to get responses that quickly from buyers or sellers on eBay. First of all, your 24 hour threat has absolutely nothing to back it up. eBay's own rules state that you should wait at least a week before you can request a refund for your listing fees because a buyer backed out. Your negative feedback would have been deleted and the buyer would have every right to leave one for you.

Anyhow, you need more proof from this buyer about the emails that he claims were sent to him. Is your email address on eBay one that you actually use? Why have you relisted a different item?

Well, for starters, you could improve your item descriptions a bit to clarify what all you expect from the deals. Possible things to include might be:
1 - "If you have a feedback rating of X or below, please contact me -before- placing a bid" This cuts down on the possibility of fake accounts being used. It gives you justification for cancelling someone's bid. If they want to contact you first, great, you've got some contact info for them now.
2 - Restate the guidelines of your communication, payment, timeline for each or something.

I'm assuming that he can leave negative feedback up until 30 days or so after the auction end. Given what his email looks like, it would probably be possible to erase the feedback.

In the case of things like the mouse driver, do your best to anticipate that, download it yourself and put it on a cd. Appear to go the extra mile and you'll have happier buyers.

i appreciate all the sensitive support and encouragement i'm getting from the people on ATOT. granted, ill accept that i pulled the trigger a bit too quick but the guy was not at all responding and forgive me for wanting to take care of all my stuff before i head back to school in two weeks.

That seems to be exactly what he said. It's BS. Leave him the negative feedback, you have nothing to worry. If he tries to leave you negative, just contact ebay and dispute his lies (he will have no proof that you said you could sell it to someone else for more and you will have proof of his BS with the email he just sent you). This guy ain't too bright.

In the meantime, try to be a bit more civil with the folks you are doing business with. Nothing will kill any deal faster than acting like a class one asshole like you did, no offense.

And fix the clock on your PC. Today is Thu July 31. Tomorrow is Fru Aug 1.

In fact, after you failed to respond, I sent the second highest bidder an offer to buy the phone at his bid (255.01). eBay has records of all this so my story will obviously win out over yours.

You know, if you had just responded to me and asked me if you could have been let out of the deal I probably would have agreed. But now that you've decided to threaten me and screw around with me, I am going to do whatever I can to make sure eBay finds out about you and deals with you harshly.

I am giving you ONE LAST CHANCE. Pay for the auction in full (I will waive shipping) -- $260 -- and I will pretend you never sent me this email.

Personally, I'm not a fan of this response, but I can't speak for others. It sounds too puffed-up, again basically threatening him with no real teeth behind it. If you want to respond, stick to the facts, the facts, the facts and let him figure out the "my story will obviously win out over yours" bits on his own.

I still can't get over the 8 emails in 3 days. 😉

As for how to contact ebay, check the ebay help system. There's also the community forums. All sorts of people there who do nothing but talk about ebay policies, procedures, etc. etc.
 
I honestly believe that ebay doesnt care about the everyday trader, i got scammed a couple times and they didnt do jack sh!t. I hate ebay!

What I was actually implying was that you were selling the one you "lost" as -well- as the replacement, not the same phone twice. Again, that's just a leap some people might make.
