I hate court

I was in court all day today, I had to evict 6 tenants for non-payment. The law firm sent us some young lawyer, looked like he was out of law school for a half hour. He's asking ME procedure questions, I almost told him to get lost. So I had to waste half the day in court. It's numbingly boring, I had to keep waking myself up.

How's the eviction process in NJ? From what I know, it's a pain in the ass to evict someone in NY.

NY has a lot of rent-stabilized buildings and areas so it's a different story. I don't manage any properties in NJ, so I don't know. The properties I manage are in PA (Philly area) and in MD (Baltimore area).

I never understood how the tenants like that plan to defend themselves in the court.

ThePresense: Your honor, the said tenant hasn't paid rent for 3 months and according to the lease they signed this is grounds for eviction.
Tenants' Lawyer: Your honor, I don't see why my clients shouldn't be allowed to live in the above mentioned building for free. Plus, ThePresense is a dirty Yankees fan.

Well, 9 times out of 10 the tennants don't show up in court, because they never had any intention of paying. This is a game they play. The eviction process takes about 3 months to get to court, so they move in and live for free for 3 months, get evicted and go play the game somewhere else. So they never pay rent. We do credit checks on prespective tennants, but these things don't always show up.
The 1 guy out of 10 that shows up in court always starts complaining about how he had all these non-existant problems in the apartment that nobody ever came to fix, blah, balh, blah. It usually doesn't work although I have seen it work once or twice.

It's not cops, it's either a court appointed officer, the Sherrif's dept. or the county constable. I try not to be around during an eviction.

exactly. I really want to know what goes through their minds. How do you expect to stay somewhere for months on end and simply not pay. WTF is wrong with these people ? I mean, it's like they expect you to just forget about it.

Happened to my mother-in-law as a landlord... they just chose to not pay for a while, while looking for a new place to live (she was kicking them out because family needed to stay there instead, which was legal). At that point, it's just get the fvck out, we'll settle the money later.

Yeah, that's one thing that sucks about the legal system. Everything takes so long. It can take 3 months from filing until eviction.

I remember a story about a lady from Fort Worth, TX who pretty much 'knew' the system, so she able to stay in a house for nearly 5 years before she finally got evicted...when some major deadling was set, she would pay a small portion of the total due that would delay the eviction process for a few months at time...forgot the other stuff she would did, but there were various loopholes in her mortgage that she skirted around.

People like that should be fvckin shot...
