I don't see the harm in checking B and then saying you do not consent to the other junk. Explain that you left your router open, but you've fixed it so it shouldn't happen again.
 
Leaving your router is the best thing you can do. See he could have downloaded copyrighted stuff and gotten away with it.
 
Oh snap! I forgot to turn WEP back on after getting my new configured... I'll have to remember to do that - right after I get a letter just like this.

Reasonable doubt ftw!
 
I am thinking option b...because I did not have the file..and no consent..because I honestly dont know what that entails

No matter if you're guilty or not- if you can show that there was a security issue with a 3rd party product, they won't have a case.

Our network provider gave us the same runaround a couple of times and it fell through due to this on both cases.
