At what point when dealing with a cop do you invoke your rights?

If you are guilty or have concerns you might be implicated in a crime you should lawyer up immediately. If you are absolutely innocent it can be beneficial to cooperate with the officers asking you questions, however. Obviously lawyering up will increase their suspicion that you have something to hide and so it can escalate their interest in you as a suspect.

Even if you are innocent you could say the wrong thing and get in trouble.

Don't converse with the officer, just answer questions asked, don't volunteer anything.


Cop: Do you know how fast were you going?

BULLSHIT

Tell that to the people that did help the cops and went to jail for years sometimes decades even though they were not guilty. Many times the cops/DA hiding something that could help you.

DAs and Cops look good based on arrest and convictions, not helping the little guy. And since DAs have to run for office in most areas they want to convict as many as possible, even if the evidance is weak or looks bad.

Nothing you say to 'clear your name' will be used to help you. EVERYTHING will be used AGAINST YOU.

on June 1, 2010, the Supreme Court ruled 5-4 that police are allowed to interrogate suspects who have not unambiguously invoked or waived their rights, and any statement given during questioning prior to invocation or waiving is admissible as evidence.

I don't think I'd pull the lawyer card when the cop asks me, "How fast do you think you were going son?". That just might be overkill.

On the other hand, if they were asking me where I was the night Jimmy Hoffa disappeared, I'd be asking for a lawyer and zipping my lip faster than shit travels through a goose.
