I bought a mattress on clearence, ends up its used

We bought a mattress on clearance from a local mattress center. The salesman never said anything about it being used, there is nothing on the paperwork saying it is used, and we even mentioned at times about avoiding craigslist because we did not want a used mattress. We were told that the mattress was on clearance because it was last years model.

When the mattress was delivered there was a tag saying it was used and was sanitized. We called up the store to complain about this, the salesman said that clearance items can be used items but they are all sanitized. He said he would check to see how long it was used but has not gotten back to us in a day.

How should I approach this? There is a no refund of exchange policy on a clearence mattress but I would have not bought a used mattress and I am pretty upset.



Quick Update:

They refunded us the money and are picking the mattress up. It helped that we went talk to them in person and they were cool about everything but they really should let people know when a clearance item is used, we found out that the mattress was used for 2 months.

If you payed with a card try and take it back. Most card companies will side with you if you explain the situation.

I would be upset too. I see them in this store all the time and the store always has a clearance sale. Sometimes they even put a matress outside with a price lol.
 
1) Try to get them to take it back. If they did not clearly inform you ahead of time that the specific item you were purchasing was used they may have violated state law. If they still won't say you'll report them to the state health dept, the BBB, and leave a review reflective of your experience online.

2) Dispute the charge (assuming you didn't use cash).
 
I saw a lot of that when we were shopping for a new mattress. Seems like all the "outlet" stores and other mattress stores were selling "clearance mattresses" that were used and sanitized.

I specified "brand new" when shopping...

As for "how fucked are you," that will probably depend on state law.

Did you pick it out in person? Or did you buy it sight unseen?
Did you get the exact mattress you saw in the store, or a different one?
I would demand they pick it back up and issue a refund, or threaten legal action.
 
yeah I watched a show on this a while back- businesses making a killing selling old mattresses sometimes reupholstered or at least sterilized.
 
Yeah I bought my mattress @ costco so I wouldn't have to deal with this shit.

We freakin' love our memory foam mattress, it retains heat though which is OK for our colder climate.
 
a friend bought a mattress from a small store that was on clearance. He and his girlfriend always complain of itching at night. They thought it was dry skin or something else. Two years later they saw a story about mattresses being sanitized. They cut open their mattress. It was black from mold and had worms living in it. It was gross. The small store is out of business.
