Hey, I purchased a motorcycle helmet at Cycle Gear in San Jose 30 days ago and went in the store to exchange it for a different size. All over the store and on the receipt there's a 100% satisfaction guarantee stated throughout. And they even say, "No hassle 30 day helmet exchange" on their business card. I brought my old helmet up to the counter and the sales associate told me to go and pick out a new helmet... so i picked up a new one and he started looking at my paperwork, and then he went to the back of the store and spoke to the manager. The manager came out and then told me that the helmet had some scratches on it and he couldn't exchange it for me. This is a $150 helmet and I told him that all over the store it states a 100% satisfaction guarantee. He again stated that he wouldn't let me exchange it. I then brought my friend in the stote (who recently exchanged a helmet that was two years old and was all scratched up). And the manager was still really firm.

What should I do? Should i take it to another store to exchange? I was thinking about reporting the manager to the newspaper's action line.

Protest in front of the store with big signs. You should also contact the owner or a general manager.

Hmm I guess I'll just go buy a $150 pair of shoes and wear them for 30 days then go back and demand an exchange for new pair, since the first ones 'dont fit right anymore'. After all, they have a 100% satisfaction guarantee.

Well, the helmet became a little loose when i was riding on the freeway. It could be really dangerous if i wear a loose helmet. The sales person even said that i could try it on for 30 days and ride with it to see if it fits properly.

Pretty much the point I was getting at. I'm sorry your friend was able to exchange and you weren't, but...

I wouldn't have given you a refund either. If it was the wrong size then you shouldn't have worn it if you knew you were going to take it back.

wtf? you damaged the helmet and expect them to just swap it out for a new one? fvckin whiny bitch. the other question is why did it take you 30 days to figure it out that the helmet was the wrong size, you are not telling us the whole story

Because i didn't use my bike for a long time. I was on vacation for awhile.

I used to sell shoes in high school. Believe it or not people actually came in once in a while and tried that. I don't know what these goons were thinking, but we usually sent them away with no exchange. Sometimes though the managers would make an exchange if they were good customers, hehe, anyways you don't want to know what happened to those returned shoes...

Did you pay with credit card, dispute based on what reciept says "satisfaction, blah blah blah, 30 days ". Some credit cards companies might help you out.


If not flea bay it for the most money you can get with it.

I dont know, don't most stores who have a return policy expect the item to be in a resellable condition at least? or else what are they gonna do with the helmet?
