Hypothetical, Neighbor comes over to my house with his dog . . .

neighbor comes over, we discuss a tree that is standing on my property but very close to his property. we decide we should cut it down after he gets back from a short trip away over labor day weekend. before he leaves my property he goes over and gives this dead rotten tree a push, his DOG which was not on a leash had come over with him gets caught under the tree as it is falling and dies.


do i have any liability?

btw, i said it was hypothetical because it didn't happen to me but it did happen to someone i know. 😉
 
Get a lawyer now. He's gonna sue you for all your worth. The murder happened on your property, so it's you're liable.

again, it wasn't actually me, a church friend of mine told me this story, it happened to him.

they are next door neighbors so the neighbor didn't feel like his dog had to be on a leash to come next door. (yes, the dog SHOULD have been on a leash).

i don't see ANY possible way my friend could be held responsible but in this sue happy society i'm not sure.

 
in this country anything can happen. The dude will try to shift responsibility for the accident onto anybody he can since people in this country just have a tough time accepting responsibility for their own actions - and getting away with it.
 
Waiting for the parody thread about the "other guy tripping" and accidently pushing the tree over and killing his dog.

actually, that's what i thought.

the dog was on MY friends property with NO LEASH.

hence anything that happens to the dog is the fault of the dog owner, hence LEASH laws, correct?
 
Doesn't matter. He suffered a loss/death on your property. your property had a dangerous scenario with the tree. turn it around and say it was a child - same result.

you're liable.

Yeah, the other guy's property was on your friend's property and due to negligence on part of the other guy, it was destroyed. Simple as that IMO, but knowing lawyers these days... :|

That story doesn't sound quite right... "Just gave it a push"?? If "just a push" is enough to knock it over, then it must have been a perfect shot on the dogs head/neck with the trunk to kill it.

Also, if it's big enough to kill a dog, you're lucky "you" weren't going at it with a chainsaw... Cutting down rotten trees like that is quite risky.
 
I've heard of pushy neighbors before, but this guy takes the cake.
