Hypothetical FS/T situation

This has not happened, to me, just wondering who's fault it would be in this situation.

You know there's a time when you want to buy some stuff, so you PM several people about similar items they sell.

Let's say you make a deal with someone and they would ship first. You agree on a price, then talk about the item's condition and provide them with your address to ship to.

They never answer your PM. You message a few days later asking them what's going on, if they're shipping, etc. No answer. So you wait a day or two, then you confirm with someone else, pay, and get it shipped same day.

2 weeks later you find out the first guy mailed it out without telling you. You also recieve the 2nd guy's package around the same time.

You only need one - who's fault is it? Yours, or the seller 1?

I'm thinking it's seller 1's fault, because they never confirmed a deal with mailing... or are you expected to wait? If so, how long?

Yes. However, it is your resonsiblity to pay for the first item or mail it back to him- he covers return shipping, or you can refuse the delivery.

in this situation, he's saying the item was delivered, so he can't refuse delivery.

I say you keep it if he won't pay for return shipping.
 
Seller 1's fault, no question.

It would be different if this happened over the space of 1 day, e.g. you talk to seller 1 and noon then buy from seller 2 at 3 PM, but in this "hypothetical" case your friend "bimms" gave seller1 plenty of time to respond.
