Hypothetical Driving Question

Let's say I'm driving on a road, we'll say speed limit is 35, cause that's a nice number. Now, let's say it's dark and I'm in the right most lane which is right next to a sidewalk.

If someone were to jump out from the sidewalk into the lane and I were to hit them, and there is no stop sign, no crossing, it's just a normal street where if you were to cross at the place you hit them, you'd be jay walking.

So, you hit them at 35mph and their flying body dents your hood or something. Could you sue them for damages?

Okay, add to the story that an on-duty police officer in a squadcar was in the lane next to mine and saw the whole thing take place. If they were to sue, I would counter-sue and win, right?
 
Knowing our legal system, the person who is at fault wins a settlement for $32 million, while the innocent person will go to federal pound-you-in-the-butt prison.

If you tag a pedestrian, you lose. In this wonderfully litigious society, you lose big. Heck, the ped could probably sue you because his attempt at suicide was foiled by your not having a big enough car.

Yup, same situation if someone breaks in to your house. Kill the bastard, that way the cops only get to hear 1 side of the story 😉
