how would this defense float against the RIAA??

Lets say, theoretically, I get sued by the RIAA for downloading forty bajillion songs off of some illegal file sharing service.

For those of you with actual relevant knowledge in this arena, how would this defense float:

I have a wireless broadband router that is unsecured and is accessible from the street, my neighbor's house, etc. Assuming they don't get a police raid to find forty bajillion songs on my personal computer hard drive, couldn't I just say that somebody could have been using my IP without my knowledge to download those songs. Wouldn't that get you off?

its your responsibliity. iF the riaa sues you and wins you can turn around and (if you can prove it) sue your neighbor for dling the songs and make back every cent you lost.

You are responsible for securing your wireless connection. I would guess that unless you can prove that you made an attempt to secure it but they broke in anyway that you are responsible.

Take a more extreme example. Someone uses your wireless connection to download and distribute kiddie porn. Who is responsible? My guess is that unless you can prove that someone else broke your security and you knew nothing about it that you would face charges.

Now lake a less extreme example. Someone breaks in to youe house and steals $500 worth of stuff. You have insurance but admitted in the police report that you didn't lock your doors. Now your insurance won't pay to replace your stuff. Because of your own negligence you become responsible.

To expect the law to protect you from your own stupidity is simply asinine. A certain level of common sense goes along with everything you do. You are expected to take reasonable steps to protect yourself and your property, and if you don't then you can and will be held responsible.

Not with photo cops, unless you can prove that you weren't the driver.
