how to write eviction letter?

My friend and I are first time landlords and we currently rent out a duplex. the larger unit has been late on rent and have not paid rent in full for the last two months. currently she still owes $700 out of $1200, which consists of $150 from last month and $1050 for this month,includes $50 late fee. We want to send her a letter, to warn her the possibility of eviction if this late rent/payment business continues. We cut her a break last month because her car was stolen and she went out to buy a brand new Neon. What should i say in the letter. We don't really want to evict her just yet because we don't want to lose a month and possibly two month's rent. any help is appreciated.
 
heh not much you can do without the courts. But it also depends on where you live.

You can write her a letter asking for the money or you will start the eviction process. Then you give her a 10day notice to pay or else. Then you get take her to court to evict her. IF she wants to be an A$$ this can take about 8 months to do.


My in-laws had a house they were renting. it was a pain to evict the people.

If it was me, I'd just be blunt and to the point.

Dear Dirtbag,

Pay your rent, or get out.

In reality, you're probably going to have to consult an attorney. Evicting someone can be especially difficult.
 
So she owes rent, but she buys a brand new car? Instead of a used one that would have saved her probably the amount she owes you?
Write the letter, give her some preset amount of time, and then live up to your word.

I'm not entirely sure we want to evict just yet. but i want to write a letter, to warn her of the possibility and maybe that'll put rent back in her priority.
 
I'd see a lawyer. To have him draw up for you or give you a copy of a good eviction notice shouldn't cost much at all.

Either that or tell them to GTFO now.

Make sure that anything you send is registered and make them sign for it as well. This can and will be proof that they got notice.

Your first step should be becoming familiar with the landlord/tenant laws in your state. That might affect what you can and can't do.

If you are worried about money, look for someone that has a free consultation or something...

If you are more worried about getting your money than getting rid of them, then just write them a letter (like someone already said, certified so they must sign for it) stating that the rent is overdue, it must be paid immediately and in one week you will begin to take legal action against her if the rent is not paid IN FULL.

Do not give the impression that it's okay if she pays you later and don't be compassionate or understanding. That's where people lose money and time.

 
kermalou has it right. 3 day notice to pay or quit. You owe x $$'s. Due in 3 days or eviction will be filed. Make 2 copies. You sign both, they sign both. You each get a copy.
