(no, i dont know anyone who has sued a doctor b4, thus cant get names/recommendations.)

If he is a malpractice lawyer then he is lousy by definition. Bottom-feeding, worthless scumbags, every one. They will convince you to pursue frivilous suits to make a few bucks when nothing actually was done wrong. They rape the system for a living and do it with a self-righteous attitude. They and the people who seek them out drive up the costs of healthcare for everyone ten-fold. If you see one just kick him in the balls and call it a good day.

Ask a lawyer you do know for a recommendation. Lawyers are generally well connected. If the lawyer you know does not have a recommendation, one of his colleagues might.

Call the local bar association and ask for several referrals.

Setup an appointment, it should be free. Explain your case. Get their opinion on the merits of your case.

Ask how many malpractice case they have handled in the past 24 months.
Ask how many they have won.
Ask how many they have settled.
Ask how long it will take to resolve your case.
Verify they'll take you case on a contingency.

Repeat at least 3 times. Go with the one who doesn't promise the sky.

complications w/spinal tap
many days in pain. Each day called doc. each day doc said give it 24hrs + pain should subside.
finally went to emergency room. a painful procedure fixed the problem

Headache? Sounds like you had a spinal headache from csf leaking out the spinal column. This is a common side effect of lumbar punctures and youll probably get diddly. The standard treatment is rest, fluids, and caffeine, if that fails, an epidural blood patch can be performed, which it sounds like you had.

finally went to emergency room. a painful procedure fixed the problem

so what exactly there is malpractice. I'm sure you were warned about possible complications and it sounds like the doctor was suggesting standard treatment.

Came to say just about that, and while he'll most likely get diddly, he'll cause problems for the physician/hospital with some more frivolous litigation.

"OMG I have a little pain from a procedure that I agreed to have. WHO CAN I SUUUUUUUUUUUUUUUUUUUUUUUUUUUUUEEEEEEEEEEEEEEEEEEEE"

I see this billboard frequently down here in South Florida. It's absolutely absurd. Couple that with the numerous, numerous radio commercials with hip hop jingles about quickly calling a lawyer to "get paid" and I just about want to rage out on my drive home every day.

This is exactly what I was posting about in yesterdays thread. Granted, we don't know all of the details, but if it is basically what you have already said and nothing more...grow up and move on.

then going to the emergency room. and they fixed it.

I've heard numbers thrown around between 10-30% incidence for postdural puncture headaches. So yeah, it is.

Maybe you can find a way to sue Slew Foot as well.....he would have done the same thing, think it will hold up in court?
