Wouldn't it be nice to cap lawyer's fee, then they would work on more worthy causes instead of filing frivolous cases to hit the jackpot.

if they cap the lawyers fees, good luck getting any of them to take the class action in the first place.

No, it wouldn't be nice. It would distort the market in favor of crappy manufacturers and service providers. Good companies would suffer a competitive disadvantage w/o the sharks to eat the weak.

If all cases have the same payout, then the lawyers will choose to sue the crappiest companies where they have the best chance of winning.

I could be wrong, but I remember hearing that being involved in class action lawsuits tends to reflect negatively on you in some fashion. Might've been for insurance, or something like that.

Also, I believe judges are ultimately the ones who decide whether or not a lawyer's fees and such are reasonable, and adjusts them accordingly. However, again, I could be wrong.

From the panasonic lamp settlement, a new replacement HDTV 50". It was either that or a 1000$ rebate on any Panasonic tv over $1,500 and you keep the old tv.

I got $26 dollars in class action underpayment when I worked for Best Buy for three months in 1998. Some lawyer probably got 26 million.

That's better than our current system where the crappiest company gets a free pass because it's small and there is no big payout.
