How many points for Reckless driving in CA?

OK, how bout some legal advice. Person A has just been handed an MIP, a reckless driving, and a theft citation. Total amount of fines we're looking at? A beer can was found in the truck person A was driving, but the truck belonged to person B. Who should the MIP fall to? Should person A hire a lawyer?


no i'm not person A or B, i'm just throwing stuff out there. 🙂

did person A get tested on the spot? yes person A should hire a lawyer... that is some deep sh!t they're in.

 
no, Person A was not arrested for a DUI, nor was he under the influence, person B was not tested either, but had some to drink.

i think person A should just get the reckless driving if that's the case... but then again i'm no lawyer so i'm just talking out of my ass

Depends. Whomever was driving typically gets the MIP, unless the other person claims the alcohol, or gets MIP by consumption. Now, this is the typical way, but it could vary by state and/or municipal code. The best thing to do with that many charges, is to get legal counsel.

Doesn't matter either way. I can think of a case right now in which I know someone who didn't know it was there, still liable for it in the eyes of the law.
