How long to give seller to respond before filing a dispute?

Bought a game on eBay the morning of Thursday, July 20th, auction stated it would ship via USPS Priority Mail within 1 business day of cleared payment. Payment was sent within 10 minutes after i won the auction. Package would travel Indiana -> Florida. 1 Business day would mean the package should have gone out that Friday, saturday at the latest. And Indiana -> Florida, even by first class mail is 2 business days.

I contacted the seller after the package hadn't arrived yet by last thursday (July 27th), and the seller told me it was mailed "earlier in the week" and to contact him if i didnt arrive by the end of the week. The package hadn't arrived by Saturday so i contacted him again, asking to see if he had any delivery confirmation for the package so a trace could be put on it. Its now monday, haven't heard anything back from the seller, and the package didn't come in the mail today either.

Suggestions?

UPDATE: The package came TODAY, Aug 3rd. The seller e-mailed me back early this morning saying he mailed it early last week and didn't know why it was taking so long, but would contact me back if he found the receipt. Stamped right on the damn front of the printed USPS label, it says Jul 28, 2006. So he mailed it last Friday, AFTER i contacted him the first time as to its status. What a freakin a-hole. Should i call him on his lie and leave him neutral?

His e-mail to me this morning;
I apologize for the delayed response. Work has been hectic and I have been working 12 hour days. Never fun.

At any rate, I will dig up the shippinginfo. I would be shocked if you do not receive it today. I sent it out beginning of last week at the latest?

Please let me know if you receive it today. In the meantime, when I get home this evening I will try to get the receipt for USPS shipping and see what we can do. All of the other packages I sent in that shipment have been received in the last couple days.

Again, I apologize for the inconvenience.

And this was his e-mail from the 27th (which now i know is BEFORE he sent the item);
It was shipped earlier this week USPS. Let me know if you have not received it by end of week.

Notify him that if there is no tracking info received from him with 48 hours; you will file a dispute.

I just had a guy take two weeks, turns out he didn't put enought postage on the CD, so it got sent back. I would give it a few more days, but the lack of communication would make me nervous for sure.

I always take all action as soon as possible because Ebay has enough buffers in place already that waiting until the last minute means you may get screwed...

Disagree. I say he gets a negative because he lied.

If he had come out and fessed up on first contact, neutral or maybe even positive.

There are no dispute mechanisms on ebay though to prevent retaliatory negatives though, correct?

I ask because he has yet to leave me feedback.

If someone leaves negative feedback, you can enter in your own comment about the negative feedback.

Agree but I was leaving that decision up to Aphex.

I have 100% after 107 transactions and would hate to have that tarnished because of one dick.

I think if you get a retaliatory negative the best they'll do is remove both negatives, so you might as well not leave feedback at all.

Not wrong at all, but you better hope he doesn't have a chance to get you back.

I've always wondered how eBay determines if 90 days have passed - whether it is 90 days from the exact second the auction ended or 90 days from midnight on the day of the auction, etc. It'd be nice to leave feedback as close as possible to the end date in the event that you have to leave a negative and the other person hasn't given you feedback.

I would just go ahead and do it now and clearly state the reasons why for the negative feedback. In the end, there isn't that much difference between 99% and 100% approval rating on eBay. It's not like you get any special discounts.

That's a dick move

Why, because i deserve a retaliatory negative? Looking through his feedback, he has left many other negatives, close to 10. Ironically, he seems to leave negatives to people that lie to him.

Thats a good idea, you should get a discount for keeping a high percentage feedback rating. Would encourage some sellers who just care about $$ to satisfy their customers.
