How long after someone moves out..

My friend's roommate moved out about 6 weeks ago. They have made no effort to get their things back. What is the length of time, by Illinois law, that someone can leave their things there before they can be disposed of?

did they officially move out? like get out of the lease and all of that or they just up and walked out one day.

If they aren't paying to live there anymore then you can do what you want with their stuff. At this point it's just like they left it at your place, so all that's stopping you is your conscience (sp?). There's no law about this situation any longer as they don't live there.

Actually, no. Some states certainly do have abandoned property laws that he must abide by.

Well they were going out, broke up, and she moved out. I'm not sure if her name's on the lease or not.

Well they were going out, broke up, and she moved out. I'm not sure if her name's on the lease or not.

i tried googleing for you however all i got were results for abandoning a child or spouse

Try that maybe? Way too long for me to figure it all out, but may be something helpful in there. Seems like 6 months keeps popping up wherever I look though, that'd be a good rule of thumb. I'd say if they've made a genuine effort to alert him to this stuff, they've kept it together and not damaged it, and he refuses to come get it, then it's time to sell/toss it, but I'd let him know first. Tell him he has one month to come get it, or you're having a garage sale to cover the cost of you storing this crap for him. Send it certified letter and all that good jazz, keep a copy of the letter, whatever makes you feel comfortable that it's legal and legit, and if he comes after you it'd have to be small claims court likely, you'd have more than enough proof to prove that you made every reasonable effort to get him back his stuff and he just didn't care.

We just had a thread involving a guy whose ex would not come and get her crap. If push comes to shove, give the roommate an ultimatum and say that if it is not picked up within this time frame then you plan to leave it out by the curb for him to pick up at any time he pleases. You cannot be held responsible for the actions of others should they choose to steal it. All of this nonsense isn't worth shoes and clothing.

Exactlly....it's the "adult" thing to do anyway. She wants to act like a little kid and not come get her stuff, fine. But at least the OP can be a grown up, give her the chance to come get it, then toss it and/or burn it in a bonfire effigy of her.
