How likely can I get out of a lease citing discriminatory rule enforcement?

I need to get out of my apartment lease contract for various reasons without a penalty or a black mark against my records.

On the lease I signed, we have a rule stating no furniture on the front patio. Many people are disregarding it and we did it too. We had a small one person couch on the patio and got a "get rid of it" warning.

Looking around, there are other people in the same complex with more furniture than we did, but never made to take down. Many have couches and such and the worst one has a freaking canvas swing set on the plain view and have been there for many months, but haven't been made to get rid of it.

What's the chance I could use the easily proven discriminatory policy enforcement as a leverage to get out of my lease?
