How is affirmative action even legal?

Ours is not a meritocracy and now you know. Your talent, experience and performance are secondary. I'm sorry you got passed over, but that's how it is. As far as legality, well, that doesn't matter either. As has been said it's legal because it is. The test is if it's constitutional, and given that Pi can be three and the tomato a vegetable although it's not, facts are arbitrary things.

I thought affirmative action only applies to government agencies or the public sector (FD, PD, government workers etc).

I guess this proves again that it is not about what you know, but who you know and blow/

I've been an intern at my company for three months. When I started, one of the programmers told me he was leaving and that I need to apply for his job (I have a bachelor's). He told me this up until his last day.

I started asking my boss and told him I'd be interested in filling his spot. Every time I asked, boss said he didn't know what was going on with that. Then, the other day at lunch, I hear they filled the position through INROADS. The guy doesn't have a programming background, but still got the job simply because he was a minority.

If that's not racism, I don't know what is. Lol, double standards FTW.

This sounds a bit fishy. But just because he didn't have a programming background, doesn't mean he can't write programs. And you say its because he is a minority, but could it be he is better than you or maybe he has earned the right to the job through his service to the company. Every minority that beats out a white person for job, it isn't just because they are minority.

All of what you say is entirely possible but don't you see that the continuation of affirmative action in a country vastly changed from when it was first implemented in the late 1960's is what leads to the questions even being asked?
