how does fmla work(in general)?

I know it might(or might not) vary by state, but I was wondering how it usually works.

Lets say my wife works for a company. She gets preggers. When does she become elgible for fmla leave? how does she become elgible and is there a determination for lenght of time she gets off?

is it based on service with the company?

i'm not 100% sure on this...

i believe it's a Federal law... she gets X amount of time off as soon as she finds out she's preggers. the company will deduct from that bank of time for each Dr's appt she takes... Cool companies won't count that against her, but it's up to them.

if the company is over a certain size, i believe, she's allowed up to 12 weeks off after birth and they can not fire her - her job is guaranteed. this doesn't apply to mom & pop jobs, though.

it's not based on her length of service.

thanks. but no one is preggers yet. :)

she just got a new job, and we are recently in discussion in when to have a baby. So I was just wanting to time it right and not do it too early. I want her to get the maximum benefit and job security.

Generally, when a covered member needs to take time off, they get a doctors note stating so. The employee then gets that time off, unpaid up to the allowable time limit.
The employer is supposed to bring them back at the same pay. Not sure if they have to give them the same job.

You also have to be working an X amount of time at the job to acrue FLMA hours. When you reach that time, you have a certain amount of hours. Depending on why you use it, say if you need need a long stretch off at once, but rather a day hear and a day there. You will need an excuse when you return to work work the next day.
