Texas Judge Allows Mom To Collect Dead Son's Sperm
Mother: I Want Son To Live On
AUSTIN, Texas (AP) ?

A judge ordered the Travis County Medical Examiner's office on Tuesday to maintain the body of a dead man in order for his sperm to be collected, granting his mother's wish for a chance to have a grandchild.

Nikolas Colton Evans, 21, died Sunday at University Medical Center at Brackenridge after being punched and falling during a March 27 assault on an Austin street.

The order from Travis County Probate Judge Guy Herman also directed medical examiner officials to provide access so an expert can take the specimen. Herman issued the orders after an emergency hearing at the request of Evans' mother, Marissa Evans.

"I want him to live on. I want to keep a piece of him," she said in a story in Tuesday's online edition of the Austin American-Statesman.

She said that her son wanted to have three sons and had chosen their names: Hunter, Tod and Van.

Evans and her attorneys were trying on Tuesday to find a urologist or other medical expert willing to collect the sperm.

Court documents said the sperm had to be collected within 24 hours of him being removed from life support unless the body was cooled to no more than 39.2 degrees. Herman said the body was being kept at the appropriate temperature.

University of Texas law professor John Robertson, who specializes in bioethics, said that state law gives parents control over a child's body for donation of organs and tissues but that "this use is very unclear."

"There are no strong precedents in favor of a parent being able to request post-mortem sperm retrieval," he said.

No arrests have been made in the assault on Nikolas Evans, which occurred after he and a friend left a bar late one night last month. Investigators said Evans hit his head on the ground after he was punched.

I've seen weirder . . . but this is kinda morbid. Imagine having to explain where the kid's daddy is when he's older.

I think its creepy, this "grandson" will live his life knowing his dad died before he was conceived, let alone born.

Did he have a gf/wife at the time of his death?

Who is going to be inseminated with the sperm? A surrogate? Who's going to raise the child?

What if the mom is lying about the whole thing just so she can have her dead son's children? :Q

It's...different. I'm not particularly scared by it though. Assuming she wants to use it in some remotely responsible way, like maybe making it available to some couple she knows who is having fertility problems, I don't see a real problem here.

I see nothing wrong with this. Using the dead to benefit the living is a clear sign of advancing technology. In fact, I find this usage of medical technology fascinating.

The only problem is what if a girlfriend or such does this so the child will inherit the dead persons fortune if the will didn't go to her liking?

I hadn't thought of that. I'm sure the living family will find a way to brainwash the child though. It is the way of things these days.

I suppose you could write something into your Last Will and Testament to prevent it from happening, if you wished.

I think that since he is an adult, only he should have say with what happens to his body after death unless he passed that power to someone else in a will.

legally she should be able to do whatever she wants with the body, but ethically this is just effed up. I mean She will never have grandchildren from him; even if the guy's sperm is used the kid will be raised in another family, not hers. She just needs to let it go already.
