U.S. Rep. William Janklow was driving 70 to 75 miles per hour when he ran a stop sign Saturday and collided with a motorcycle, killing the cyclist, according to a report released Wednesday by the South Dakota State Patrol.

It's not uncommon for Janklow to comment about his driving habits. In his 1999 State of the State address, then-Gov. Janklow referred to his driving record as he promoted increased jail penalties for drug dealers.

"Bill Janklow speeds when he drives. He shouldn't, but he does. And when he gets a ticket, he pays it," Janklow said. "If someone told me I was going to jail for two days for speeding, my driving habits would change. I can pay the ticket but I don't want to go to jail. It's that simple."

Treat him the same as you would if it had been Joe Schmoe average speeder in his Pacer that took out the motorcyclist. That being said, I don't know if I believe in a long sentence for blowing through a stop sign, he wasn't drinking, just made a huge driving error.

I wouldn't call someone who blew threw a stop sign and cost someone their life a murderer. He didn't set out to kill anyone that day, sometimes bad things happen in this world, this is one of those really bad things.

normally i would agree, but his past history and public statements regarding motor vehicle safety seems like unordinary circumstances

if i was the D.A. , i would go for vehiclular manslaughter and hope for at least some kind of negligence conviction
 
Mumme told mourners that Janklow had spoken to him about the accident and his grief and that he will carry the guilt for a long time.

"I lost a deep, deep, close, close friend," said Terry Johnson, a pallbearer who was riding with Scott on Saturday when the accident occurred. "But I still feel deeply for the Janklow family and their close friends also. I just can't imagine what they are going through."

Janklow's son, Russ, said Wednesday that his father is devastated. "My dad is a father and he is a grandfather. He has an appreciation for what this family has suffered."

Russ Janklow said he doubts that his father, a Republican and political icon who served four terms as governor before being elected to the U.S. House of Representatives last fall, has given much thought to how the accident will affect his career.

"He's dealing with emotions of guilt and feeling terrible for the family involved," he said. "I don't think my dad is spending five seconds on how this will affect his political career."

Would this apply to DWI also?

Of course it would, though with a DWI it would show a far greater negligence which would equal a far lengthier sentence. I guess I see a murderer as someone who knowingly takes anothers life. That being said, I don't pretend to know the legal term for a "murderer".
