I posted video from dance class, It was a 50 second video of the instructor recapping the moves we learned - the music is playing in the background.

Big Music put a claim on it because of the background music.

I appealed and explained that it was background music from dance class; i got an email from youtube to the effect of "they think its still copyright violation, so its blocked". wtf? can't big music sit there all day long clicking "nope, denied".

Appealing again goes right back to Big Music - what am I supposed to do? Its stupid without audio - you need to learn/pace, and the moves are timed to the music...am I being too obtuse, and i should have assumed this would happen?

Unless you're ready to travel and lawyer up it's not worth it. The system is retarded. Copyright in general is retarded now, but Youtube just takes it a step further as they don't recognize parody/satire clauses or fair use. Background music on a non commercial video should be fair use imo... but it's not. Part of the issue is that it's based on AI, and AI can't really distinguish what is a parody vs just pure infringement.

The best way to get around it is at the video production stage, any background music you use should be played slightly slower or faster and it won't get picked up. Idealy try to find libre music though even that gets flagged at times since if some big company also happened to have used that music then they are seen as the owner.

Happened to a video of me doing a walk through around the warehouse with soft music playing in the background.
Got a message that the music playing in was "copyrighted" and to be replaced with some "generic" music. No big deal to me
since it was not related to the video.

What pisses me off with this copyright extremism these days is that we will literally lose large chunks of history. Music, video, etc. Nothing will be preserved/recorded because it's infringement and illegal to do so. Was watching a video of someone driving around my city like 20 years ago with radio playing, and it's kinda nostalgic to hear the old songs that used to play while seeing old buildings etc in the city. Simple things like that are just not possible to do anymore without getting flagged or even arrested. Ex: if you were to just host it on your own server and you get caught.

I guess in theory you could record stuff like that on long term media and in a couple hundred years from now the copyright may have expired on it.

I love how YouTube has tons of copyrighted music videos and yet I had to take their bullshit copyright school after a video I had on there for over 7 years got hit with a copyright violation.

Facebook is the same way.

Yeah I don't get how they pick and choose what to allow. Well it's probably because they get so much ad revenue from certain videos they rather not flag it. It's probably part of the algorithm to flag, if the video is making them money then they'll let it go. If you're just posting random vids for entertainment and don't care about money and don't get much traffic then it gets flagged.

What's really annoying is that copyright applies to sound/music that SOUNDS like something copyrighted so even if you make your own music you're not in the clear. How can you produce something and consider every possible copyrighted song in existence to make sure that yours does not even slightly sound like an existing song? It's retarded. The copyright system now days is strictly there so it can be used against small guys by big corporations. It's no longer about protecting work.

There needs to be a competitor to Youtube and it needs to be hosted in Russia or something.

Playing a recording of a radio broadcast isn't the same as the radio broadcast because you have control of your recording. And the radio station pays a performance fee when they play the music based on the size of their audience. They wouldn't know to add your video audience to that.

ANSWER: you can counterclaim through the youtube website. once you do, they have 2 weeks of time to bring legal proceedings against you, which they will not do, and the video will return to you.
