How do I file a lawsuit against Comcast?

Here's a bit of explanation first.

I use the mail forwarding service at pobox.com. So I'm XXXXX@pobox.com and I can have it forward wherever I want. I currently have it forwarding to my Comcast email address. So basically, I never EVER give out the comcast address.. period. No exceptions, no special cases..it's never ever happened.

Now, suddenly, I'm getting spam mail sent to me @comcast.net. Maybe I'm not seeing the big picture here, but this clearly indicates to me that either Pobox.com or Comcast sold my e-mail address to a marketing firm.

I suppose I first need to figure out who did it... I have a feeling it was Comcast though. And no, the spams aren't official looking emails from Comcast talking about their other services. It's actual spam (e.g. "Need cash now??" and "TERMINATE CREDIT CARD DEBT!").

Secondly, how do I go about filing a lawsuit?? Clearly this action is illegal, and someone actively sold or gave my email address away. I am PISSED, and I want to take action...but without proof of which of the two companies committed the crime, I won't get very far.

Even if I told you we both know you wouldn't bother going through with filing the lawsuit. You're just ranting and upset :|
 
I haven't gotten any spam on my comcast email, and I'm a bit less paranoid about security than you are, so I don't think it's them.
 
well comcast has the right to sale the email.

anyway stop trying to act like a hotshot. we all know you wont sue them. Even if you did odds are you will lose. sheesh stop acting like a baby.
 
First, read Comcast's privacy policy. I doubt you'll want to sue after reading it.
 
click the "logout" button located to the right of the "home" button. Follow the instructions given to you there and you're home free.
 
I've had several comcast.net email address' and never have I received spam mail...

bleeb: apparently you're clueless about spam filters. Even the best ones like POPFile have trouble. spammers keep finding new ways around the newest filtering methods. First, Bayesian was all the rave.. now that method is useless.

And I'm not trying to be a "hotshot." That's a ridiculous statement. I guess I'm just more anti-spam than the rest of you.

So show me the part of the privacy policy that says they will give/sell your e-mail addresses to third parties. I saw the part that says they may send you promotions about Comcast services, and may give your personal info to 3rd parties for tech support purposes, etc. I didn't happen to see anything saying that they'll sell your info to Super Spam Marketing.

ok, so that means you don't know which of them sold your email - you can't tell. so emails forwarded from Pobox look the same as emails straight to the comcast acct.

okay, then, prove some spam bot searching webpages for email addresses didn't pick up your pobox address and email to that one, eh?
 
No, that's not true.. if an email is sent to pobox.com, I can tell from the routing on the headers. These emails are being sent right to comcast. Not to mention that my comcast email address is right in the To: list. I do get a few spams at pobox.com, just because other people I gave that addy to screwed up and fell for some "send this to a friend" thing. These new spams are definitely being sent to me @comcast though

Maybe one of these places leaked your address.

 
My email address is not easy to figure out..there's no way it was randomly generated by them. Like if someone had an email bobtjz9754@comcast.net, no one would ever randomly generate that email. Or perhaps they would, after running through trillions of other combinations of letters/numbers.... who knows. Doubtful though.

OK. now all you have to do is prove that comcast sold the email and whoever sent it didn't get it from someone else, that whoever it is didn't just spam all the emails.

Now for damages. WTF do you think you are going to get? that is if you can even afford a court case against comecast who has far more lawyers and can bury your a$$ in court proceedings.

Again stop being such a baby. until they ban spam you have to learn to live with it.
 
Well, aside from it being apparently "illegal" for them to sell an email address that... in every technicality... belongs to them, you won't have much grounds for a lawsuit if you can't find what damages it has caused you.

What, are you gonna sue to make them tell the spammers to stop sending stuff?

I doubt you've lost any more than 2 dollars worth of your time deleting the mail. Sorry buddy.
 
I'm sorry, it was my bad. I gave your email address to Nigeria so they would transfer 15 million dollars to my account, make me lose weight dangerously fast, make $10,000 a day working from home, reducing my debt using a new proven method, and verify my ebay and paypal information.

Unfortunatly, it turns out it was somewhat of a scam, but you can unsubscribe, and that will get you removed from the mailing lists.




ok, i admit it, I am full of crap, sorry.
In a more serious note ...

Attempting to sue comcast will be a waste of your time and money. If you are that mad about it, get a different email address, or change ISPs. Or try to go after the spamming a$$hat's themselves ... they are the ones who are sending the intolerable amounts of junk mail without your permission.
