No, you don't have to get a patent first before you start your design-- besides, the application process can takes months. Getting to the market FIRST will only bolster your chances of succesfully receiving a patent anyways.

However, before you will likely get an VC money you will have to have some sort of working prototype. This is where you bring in one or two or three really dedicated application designers who are willing to work for cheap, or free, on the side in exchange for a share of the final product.

You might even be able to find a few here on Anandtech willing to take this on... I know I might if the idea is right.
