How come restaurants arent required to give breaks?

Out of curiosity, how come restaurants arent required to give any type of breaks? In all the restaurants ive worked at, working shifts anywhere from 4 hours to 10+ hours, there are never breaks. No, this is not a feel sorry for my plight post, i am so used to not having breaks, that it doesnt even phase me, I can work 8+ hours without going to the bathroom, but was just curious. I remember when I delivered pizzas for a short time a while back, I was told, the breaks are when your driving in your car your sitting down=break. Just wondering how restaurants seem to be exempt from giving breaks.

No breaks during peak business hours like around noon is understandable, but no breaks at all sounds like you're working in the wrong place and under shady management :roll:

I don't know, I guess you don't get a break... which is BS. I'd be pissed if I worked at a restaurant and didn't get a break.

Yeah it actually works out better for the servers since taking a break=no tables and no money.

If a server takes a break that leaves their tables without service during that time period. Or, it dumps their tables on another server unfamiliar with those customers and their needs. Whichever, from the standpoint of management that's unacceptable as it leads to unhappy diners. It's part of the job, if you don't like it don't take the job.

Michigan employers are not required to give breaks to employees over the age of 16. Check state laws for your location to confirm.

I dont have a problem with it, I can easily work 8+ hours without even going to the bathroom. I was just curious about breaks because it seems Best Buy lost a class action lawsuit or something like that, http://forums.anandtech.com/messageview...atid=38&threadid=1524344&enterthread=y and I was wondering why Best Buy had to pay, was it because they did not give breaks?

Without seeing the best buy litigation, I would have to venture that either a.)the litigation only applied to states with a law, or b.)Best buy was nationally letting their workers take breaks, but not paying them for it.

when i was a server, if we worked a double shift, more than 5 or so hours, we got at least a 30 min break, i mean you can choose to not take if you want those extra tables

There is for minors. Other than that though, most employers put them in their employee manual and then *frown* on them.

not directly related but how many restaurants have you worked at? what were reasons for leaving? which one did you make most at?
