this is ridiculous!

i feel like this is cruel and unusual punishment....


long story short... i was on probation for 6 months, for possesing 1 gram of marijuana.

the terms of my probation were to stay clean for 6 months, attend narcotics anonymous classes, a drug education class, and to complete 40 hours of community service.

i completed all of those.

however, i was arrested again for posessing phenobarbitol 4 months later, an anticonvulsant...

i let my p.o. know about the arrest first thing, and was told by her to keep on doing my community service and classes and that it shouldnt matter because i wont actually go to trial for it until after my probation is completed... (it usually takes 6-8 months to go to court in my county)

so last week i went in for my 5th month probation meeting, and was informed there was a warrant for my arrest, and they had motioned to revoke my probation....and i could either be arrested there or turn myself in...i of course opted to turn myself in...

contacted the courts and it turns out my warrant is set for NO BOND? what the fuck???

so basically if i get arrested, i'll sit in jail until my court date comes up for the probation violation...which will be 6-8 months!!!! thats longer than the punishment will probably be, and also i'll lose everything..it will basically ruin my life.

how can they do this?

Often, a probation or parole hold requires that no bond be set. You've already proven you can't live up to the terms of your probation, so they hold you to be sure you show up for court, knowing that you will most certainly get jail time instead of more probation. VERY common.

Be sure to invest in lots of Soap-on-a-Rope...

yeah, pretty much. isn't the penalty for committign a crime while on probation lik immediate jail time or something anyway?

Exactly - this is nothing that "they" are doing - it could have all been avoided.
And shit man - if you're on probation and still possessing narcotics, then your dumb ass deserved at least some of what's coming.

so are you done with probation or in the 5ht month?
Either way you were carrying drugs (non prescription I assume).
Pay the price.

i dont know...the bail bonds office seemed to think it was ridiculous too, and told me i needed to get a lawyer asap.

i'll do drugs until the day i die, i see no reason why using drugs should be illegal when it's legal to drink alcohol and smoke tobacco... what's the difference?

it's ridiculous...

all this started with 1 gram of pot... and here in Texas you have 1 gram of pot on you your spending the night in jail too.. in my case it turned out to be a weekend...

If I understand correctly, when you're on probation isn't it sort of like being on parole, but without having been incarcerated in the first place? That is, if you screw up you have to serve the sentence that you otherwise would have served were you not given probation instead?

If I am incorrect, it is because I really have no reason to know how all this stuff works. You, no the other hand, obviously do have a reason to know how this stuff works, and you really ought to educate yourself on it.

what i meant is i had finished everything i was required to do for probation, never failed a piss test, i was just waiting for the time to be over...
