Home owners.......HELP!!!

I just got a call from my sister saying that she had 4 feet of raw sewage in her basement. This comes from a trailer park when there pump goes down, it backs up in my sisters basement. This happened last year too! They just finished laying new carpet from the last time this happened to her. They do not have insurance that covers this! They call the owners of the trailer park and they tell her that it isnt there problem! Same thing they told them last year! My sister has called a few lawyers, but they didnt handle this type of case and didnt know who would. Do any of you guys have some ideas as to what they can do here? They dont even have there washer/dryer/furnace/freezer/fridge paid for from the last time this happened and now its happened again!

are you sure there is no insurance for that? I konw that the guys at work all have sewer backups in their policies, usually for $1500 or so.

They have no coverage for that. This is the second time this has happened, they called insurance company and once again were told that there is no insurance to cover it. Insurance says the trailer park is liable, the trailer parks says "eat sh!t". A lawyer wont touch it, so far anyways.

find a lawyer who will touch it, she needs to have a backflow preventer put in her plumbing system or something

I'd tell her to take them to small claims and use a court-appointed lawyer. Hopefully, the threat of a lawsuit will be enough to snap the trailer park owners into the right track.

did she think the insurance company would magically change their minds? why didnt she think it was gonna happen agin? and why in the world did you lay new carpet down?

Most homeowners policies do not cover sewage backup. A few do. Your sister is pretty much SOL unless she can get the court to find the Trailer Park liable.

Contact city hall or her local municipal office and speak to someone from the Board of Health or Public Works.

</B>Well, in 18 years it has happened twice. She was told by the trailer park owners it was a freak thing that wouldnt ever happen again. So, you dont use half your house because it might..........might.........backup again? The carpet is the least of her worries.....the only place they have to put a furnace, hot water heater, washer and dryer is downstairs. And sheetrocking isnt cheap, and its time consuming ripping out wet rock and putting up new everything. Sewage soaks into the wood frames so that also has to be torn out. I guess they could have just boarded up the basement and not ever used it again. I know that they cant afford 25k to dig up the sewer and run there own from the road, a 1/4 mile away.

We have had record rainfall in Minnesota this month too, that hasnt helped the situation. They had 6 inches of rain last night alone. Its nuts up here. And yes, it is sewage not rainwater in there basement. They took pics of it coming up there toilet in the basement.

City Hall told her that it is private property that the trailer park is on and they, not the city are responsible for the damage. But of course they didnt know a lawyer that would take the case.

Local News might be a good option. Call a few TV news and papers and see if anyone is willing to do some work for the story.

I think in some areas it's illegal to put a backflow preventor valve, not sure though. As said above, Department of Health and/or Public Utilities would be able to provide information on that.

I'd also have a few plumbers come out and give estimates on what they can do to prevent it from happening again. That would probably help your court case too, if they find that the problem is not your plumbing.

The whole point of insurance is for what "might" happen.

If your sister has a mortgage on the house, I find it odd that they don't have homeowners insurance which would cover this problem. If they own the house outright, they should rethink their insurance carrier. Be that as it may, your sister needs to be more diligent in locating a lawyer. I don't mean the local Yellow Pages, get on the net and start looking. If she wants to get this settled, you can't go City Hall, you go to a lawyer who is protecting your interest. City Hall will always protect themselves. Local press will get rattle the cage but the legal system will make them pay. MHO Good Luck

She needs to have a check valve installed on her sewer line. Stuff goes out, but won't come back in. I'm not sure if they make one for sewer lines. I can't imagine somebody doesn't.
