Clear Sky is an excellent game...I have a VisionTek 4870 that runs it beautifully. I paid $4.99 less for a used card!

From what I can tell - the vendor handles warranty issues with HIS. Their website has nearly nothing about their warranty policy except a blub which states to contact the vendor for RMA issues.
