Hey Everybody...need some advice here...

Alright..well...to start off...I've been a server for a while now. I was working at a nice restaurant making good money for about three months now, and on Saturday night I closed. When the manager was leaving, I asked when I had to be in, because the schedule wasn't up. She said she would call and let me know.

That was Saturday night. No phone call came on Sunday, so I called Sunday night, and a different manager said she would call when she did the schedule. Yesterday I didn't get a phone call and, again, called and was told the same thing. Finally today I didn't get a call, so I phoned in to work to find out that she wasn't there, the schedule is made, and I'm not on it. When I asked how it was possible for me not to get a shift all week, he said, "Well that means you don't work here anymore."

So just like that, without any notice, not even a phone call, I was let go. I understand that my employer can cut employment at any time, just like I can, but don't they at least have to tell you? Ethically they should give me two weeks to find another job, but to not have to decency to tell me I don't have an income anymore...that is just mind-boggling.

So anyways...my question is: Can I do anything legally against them? Should I?

go i nthere and talk to them. if u really are fired, make sure that someone else hears the convo in case u file for unemployment and they deny firing you.

Sounds to me like they're trying to avoid paying you unemployment & want to make it seem like you quit.

Start by documenting everything ... maybe bring a friend with you when you stop by to speak with them to witness what happens in case things get ugly ... you could also consider secretly recording the conversation although I'm not certain that would be 100% legal.

I know it differs per state, but when I checked it out, I don't think I'll be eligible for unemployment. It said you have to have only one job in the past 6 months, and this was my second...

They don't ethically need to give you 2 weeks notice. Not much legally you can do and not worth if you could. I'm guessing they suspect you of doing something wrong and don't want to confront you about, that or you're just not the right fit for them. Tell that you enjoyed working (and love the food) there but are perplexed about how and why you were let go. Ask if was something you did wrong so you can avoid doing that in a future job.
Whatever reason they give, just thank them and leave.

I came late about 3 times in one week. That was two months ago. Since then, they cut my shifts and treated me like a piece of scum. I'm used to that from customers, but not from employers. I had a better time working for a greedy corporation like Ruby Tuesday's. Anyways, I wasn't late for two months, and, they randomly let me serve on Friday night, and I ended up winning a contest for having the best sales.

I don't really want to sue or anything, not that I could...I'm not like that. I just don't like it when people don't think of anybody but themselves and their money.

You made them money! Sometimes bosses can just be azzhats. Yeah you got a bum deal from them. Show more character than they were to you and be gracious at your good bye talk.

Sorry to hear that. A friend of mine back in Atlanta had it happened to him twice in a row. He did look serious about taking legal actions second time it happened, but he didnt really do anything at the end.

Take the high road. If you do anything spiteful or in revenge you will regret it.

Are you owed a paycheck from last week? Go in to get it and speak with them. They should at least have the decency to tell you why you were dismissed even if they are acting like cowards right now.

UPDATE

I went in yesterday and talked to my boss and manager. They say they didn't call Monday because they assumed I would come in to grab my paycheck. I didn't, but they still didn't call. They assumed the same thing Tuesday, and still didn't call. They kept beating around the bush about why they couldn't call me.

As far as why they let me go, I think they are taking it out on me when it wasn't my fault. During lunch last Friday, table 1 was a VIP. (A friend of the owner and usually a pain in my ass...they expect psychic service.) Two things went wrong: There was a hair in a salad and a piece of glass was in another dish. I didn't make the food and I didn't bring it up from the kitchen. He bought their lunch for them, but beforehand they bought desserts and coffee and espresso and everything else they could get for free. He said he let me go because of the complaint from that table. How ridiculous is that?

I'm willing to let it go. I was calm and respectful when I went in, and when he offered for me to work in the back of the house I didn't give an answer. I'm gonna call today and tell him no. They didn't treat me very well at all there...they expect you to take 9 or 10 tables at once and have all of them maintained perfectly.

To end, I wanted to share one experience that really showed the lack of respect my manager had for me. I was asking her a question at the host stand one day, and when some customers, some VIPs, were walking out, instead of letting them step around me, she decided to shove me out of the way so they could pass. I looked at her like she was crazy and the ladies thanked her for moving such an annoyance out of their path. That was a few weeks ago and it made me realize that these people don't have any respect for less fortunate human beings. (I'm poor and I struggle to buy food. They aren't and they don't.)

I can't but point out if you struggle to buy food you should not be paying for internet or have a computer. If you are posting from a library or something, you still should be out looking for a job, working, or reading books in the library to further your knowledge so that you can get a job.
