Pregnant NY woman says she was put in chokehold by NYPD officer

NEW YORK (Reuters) - A New York woman who is seven months pregnant complained on Monday that she was put in a chokehold by a New York police officer after barbecuing outside her home, fueling a controversy that has raged in the city following a man's death linked to the technique.

Rosan Miller, 27, told a news conference set up by civil rights advocates that she was in "a lot of pain," following the incident, which was recorded on cell phone video and shown to reporters. Miller said police questioned her and her husband, Moses Miller, 34, on Saturday for grilling outside their Brooklyn home before the scuffle took place.

"The community is traumatized," said former City Council member Charles Barron who stood beside Miller at the conference.

"And, all for what. All for what? Barbecuing?" he said.


The allegation comes days after a Staten Island man, Eric Garner, died in police custody after being put in an apparent chokehold by an officer during an arrest for selling untaxed cigarettes.

Chokeholds
have been banned within the department for over two decades, but in recent weeks several videos showing police using the technique have surfaced prompting widespread outrage.

Miller's arrest was under review by the NYPD's Internal Affairs Bureau, police said. Police declined to give further detail on what specifically they were investigating.

Police said Rosan Miller was given a summons for disorderly conduct, while her husband and his brother, 29-year old John Miller, were arrested on misdemeanor counts of harassment and obstructing governmental administration.

Mayor Bill de Blasio, who came into office promising to mend frayed relations between police and the city's Black and Latino communities, addressed the growing controversy of NYPD chokeholds and expressed concern about Miller's case at a news conference on Monday.

"We've made clear, both the commissioner and I, what our view is on the use of chokeholds. And it's not acceptable under any normal circumstances. But I don't want to rush to judgment," de Blasio said.

Police said last week that they were probing the arrest of a man who said he was placed in a chokehold after walking past the turnstiles at a Manhattan subway station without paying a fare and refusing to show police his identification.

The Civilian Complaint Review Board said last week it had launched a comprehensive study on the 1,022 chokehold allegations against the police it received from 2009 to 2013.

It drops below at the front with his hand in front of her shoulder. Picture 2 is the closest to one but it still appears that his hand is at the front to her shoulder. In none of the released pictures does he appear to be applying pressure to her throat/neck except to the side where his arm is coming over her left shoulder as he reaches around her upper chest area.

The confrontation/arrest may well be bogus (they seem to usually be in situations like this) but based on what's been released to the public it doesn't appear to be what it's being painted as.

I think they said there was video, but why isn't the video out? It is hard to tell by the photograph stills. He does have his arm around her throat. But it looks like a struggle taking place. Why are they struggling in the first place?

All this over grilling?

Apparently the city doesn't allow barbeques in the front yard and they were told that they had to move it to the backyard. Then the blowup.

She just wants the $$$$$$$$$$$$$$$$$$. Nothing I saw indicated a " Choke Hold " or anything near it.

What is sadder than the OP posting this is that she will probably make big money off of it.

If you call that a choke hold - the most piss poor choke hold I've ever seen... at least from the pictures. It's funny how this keeps happening in NY and yet - all cops get a bad rep for it... maybe NY has the problem and not the cops...

There are cases where choke holds are necessary. In the pictures - hell - it just looks like the cop is trying to control this woman and there is no choke hold that I see... the article doesn't go into any detail of why the scuffle started or how it started or gives a video that maybe gives you insight to the situation... so... I couldn't say either way on this one at this point. BBQ? Sounds like they were there to make arrests, not just for the BBQ... but maybe that was their PC to go into the home - I don't know - like I said - article doesn't give you any information.

After that other incident was blasted on the news - it seems to me like this lady is making her situation sound worse than it was for shits and giggles - for money - for publicity - who knows. People are crazy. Shit - for all you or I know the cop was trying to keep this woman from stabbing herself with a BBQ fork... sounds crazy doesn't it... but it is still possible.

I had my own opinion about using force , chokeholds till I worked in ER, a female only ER, I saw a very pregnant inmate that went to the bathroom alone, the police at the close door, the woman managed to climb to the false ceiling and started to crawl with her weight she fell trough the ceiling in the next room where a rape victim was being examined by the doctor and a nurse, she landed on top of them, she became violent, not even 6 people could hold her, only a chokehold could., we stop her from harming the unborn baby.
Another time a 13 year old that got violent needed several security officers to restrain and only a chokehold stopped her from hitting the medical staff.
People that work at desks, paperpushers do not have an idea how is to deal with a person out of control/
Maybe police should start suing the ones that get violent....

Fact: A 'headlock' can become a 'choke hold', either by accident, or on purpose. If the officer is not able to safely apply a hold on a suspect, he should not try it, at all, unless life is threatened. You don't risk killing someone, unless there is a clear threat to life if you don't act.

I am sick of hearing all these stories involving police abusing their authority, even if this was not such a situation. It must stop. Period.

I'm usually on the other side of the cops, but here it does not look like a choke hold. If they want to say that the officer was reckless then maybe, not to me, but maybe. It sure does not look like a choke hold. And if the law is you cannot grill in the front, then that is the law and the cop was just doing his job.

Yep, the cop definitely should'a put a two handed reach around breast hold or nipple twister on her instead of going for the over the shoulder restraint. Much less threatening and a whole lot more pleasant for the both of them.

Doesn't look like much of a choke hold from the pics. Arm around neck, sure, but AFAIK that's a good way of controlling someone. The big issue is he didn't get her arm around her back.

I think every police officer should be well trained in the art of Aikido. It would go a long way toward restraining uncooperative citizens without harming them. I especially like some of the grips and holds that induce temporary paralysis.

Is it an arrestable offense? Or a fine? The cop being the authority should know how to exercise restraint. Fine her and move along.

...While Miller appears to have something in her hand during the struggle, the full circumstances surrounding the arrest are not yet known

The cops wanted to go into her house to arrest people and she wouldn't let them...

To me all these things say it might be more than just because of a BBQ... however they want to spin it.

and this statement: “I know the police are there to help us,” said the mother of three, who’s expecting to give birth to her fourth child in September.. “But this time they didn’t show that. I’m in pain. A lot of pain.” - sounds like she's looking for money through a lawsuit.

The officers are also not under any disciplinary action... like I said... story sounds fishy.
