Help with a laptop battery problem

I have a Toshiba 2805 laptop. Right now I have WindowsME installed on it. When I turn it off and unplug it from the wall (windows reports battery charged 100%) and leave it sit overnight or for a long period whenever I turn it on the battery is always dead, windows reports it at 0%. I thought maybe windows wasn't shutting down the laptop all the way so I disabled standby and hibernation. Still happens. Do you guys think the battery is going bad? The battery is only about 8 months old.
 
sounds to me like the battery isn't keeping its charge!
it should still be under warranty though so try getting it replaced.
