Help needed for a car accident

Last Friday on my way to work, a van blocked a plaza entrance (the plaza which I work in). My car waited behind the van. All a sudden the van backed off and smacked right into my car. My car got a hole on the front and the van had some scratches at tail.
Here are some additional details:
1. My car did not have any move during the accident.
2. I gave all my info to the driver of the van (driver license, insurance card), but she only gave me her driver license number orally. When I asked for the insurance card, she only gave me her name and phone number and asked me to let my insurance company to get the info.
3. I did not get her insurance company name and policy number until I called my agent. The agent said that she had already filed a claim to my insurance company.
4. After I got her insurance policy number, I called her insurance company and filled a claim.
5. No witness. The only proof is some pics I took by the cellphone.

I need some help here. As I have only the liability, I have to deal with her insurance company myself to get the compensation. What recommendation do you have in such a case? If the one who hit me lie to her insurance company, will that be a lawsuit? If yes, please give me some advices on a lawsuit for a student with limited budget.

Woah, she's lying and saying it was your fault? :confused: Calling the police at the time would have been a good idea, but they may not have come anyway.

RossMAN had a similar accident, hopefully he'll chime in. :)

call the damn cops on her. Tell them she wouldnt give up her info. Your the damn victim. I know someone who plowed through a minivan with his grand am and got the insurance company(S) and cops to believe she hit him. I no longer talk to him. I hate those people.

My accident was a little similiar in that it wasn't a traditional traffic accident, it happened in a parking lot en route to a busy street. My biggest dilemma was do we file an accident report with the DMV or not? After freaking out (a lot) and asking a bazillion questions, I decided not to.

nn2000 - Hopefully the van driver will corroborate your story, that will make it infinitely easier. We were lucky that the guy who backed into us told the truth and his insurer (State Farm) quickly handled our car rental and repairs.

Why didn't you call the police immediately and file a report? We did but the 911 operator asked if anyone was injured? My wife said no, so they said no police is necessary.

Man, you are not the one at fault. Don't give out your insurance information. If she doesn't provide you with insurance, you should have called the police on the spot. Plus it's the back that hit your front bumper. Without any witnesses or anything, it's pretty obvious that you will become the one at fault.

For accidents, you ALWAYS get a police report. Otherwise, it's your word versus theirs. Your insurance company is going to get substantially less from hers since there is no report backing up your side of the story.

She said you were at fault and that wasn't a huge red flag at the time? You're probably screwed. You have damage in the front and she has damage in the rear. Good luck convincing anyone it wasn't your fault.

I would have insisted on seeing the drivers license and insurance card. In our situation we swapped drivers licenses and insurance cards at the scene of the accident, 10 minutes later we were both done and drove off.

Yes if you don't call the cops and hand out all your information to the otherside.
Think about it. What can you do to prove you didn't hit her car?
When you give out your insurance no. and she didn't, it makes it seems like you admit to be at fault.

When you give out your insurance no. and she didn't, it makes it seems like you admit to be at fault.

Will insurance company rely on something other than facts?

Well regardless, she made a claim against your insurance. Hopefully they don't jack up your rates.

My wife and I were in an accident recently, and the van that hit us in the rear and the truck that we were pushed into suffered pretty much no damage, but our car suffered > $13k damage. Funny how that works.
