Help Needed AMD 3400+

I ordered a AMD 3400+ retail box processor from Compu-Terra. They called me 9 days later to tell me it is not available and for $22 more they will send me a better processor and fan. After letting them know how I felt and telling them to cancel my order they said they would not charge for the upgrade. I was told the processor had a 3 year warranty from AMD.
The package arrived today and what I received was a tray processor, not the retail box. I checked amd web site to verify the numbers. I was also told this would be the processor with the 1MB of cache, it isn't. It's number is ADA3400AEP4AX. According to AMD this is a 2.4 ghz procesor with 512 cache. They also sent a TR2-M6 cooling fan. I have sent them an email demanding either a full refund or a price adjustment and threatened to file a complaint with my credit card company to with hold payment as well as file a complaint with the Ohio attorney generals office over their business practices. Am I over reacting? Boy I'm pissed.
Any help here is appreciated.

Ok first of all, your original order was for 754 right? Also, secondly, you have every right to complain, and you are not overreacting.

Man, that's awful. The nerve of them sending you what you asked for in the first place!

Ketchup did you read the post? He did not ask for an OEM 3400+ at all.

You're not overreacting at all, they screwed you over and shipped you something different that what you ordered. They're likely skimming profit off of the price difference between a 3400+ RB and a 3400+ OEM w/cheap fan.

not overreacting. get a full refund making sure they pay shipping costs as well and order from someplace else.

I ordered a retail box 3400+ 754 chip and they sent the OEM "tray" processor. I was told the chip I ordered had 512 L2 cache and the chip they were sending had 1mb cache. They also told me the chip had a 3 year AMD warranty. Unless I am wrong the OEM chips only have a 1 yr warranty and the AMD website for my chip number states 512 L2 cache, not 1mb. I ordered the retail chip because I wanted the 3 year warranty. I checked the numbers on the chip and it is the "tray" processor. I did not recieve an invoice either, just the processor and fan in a power supply box. Crap packing job now that I think of it. I think only a full refund will do at this point. I will order from a more reputable dealer, any suggestions?

You ordered an Athlon 64 3400+ (2.4GHz clock & 512KB L2) in retail box, and instead they sent you an Athlon 64 3400+ (2.4GHz clock & 512KB L2) tray and a TR2-M6 cooler, right?

It sounds like they dicked you around, but in the end you got what you wanted. What's the difference if you got a stock cooler or that Thermaltake number? The CPU is the same, right?

He didn't get what he ordered. There is a big difference between oem and retail chips as far as warranty.

There is no 1mb 3400+ though, it is a 3700+, so I think they were mistaken. Since you never ordered a 3700+ you can't hold that against them, however you have every right to be upset getting an OEM chip +HSF when you ordered a retail chip.

I can't imagine the AMD warranty being worth very much, but if that's all you're missing, call Compu-Terra and tell them that you want them to send you a written 3-year warranty.

Look at it this way: They're never going to refund your money in full. Even if they give you your money back (which is unlikely), I bet they'll still make you pay for return shipping.

It's not fair, but that's life. My suggestion would be to ask for a reseller warranty in place of the AMD warranty. They'll be much more likely to grant you that much than to give you your money back.

I could have purchased an OEM chip with a fan for $165, I paid $201 for a retail boxed. They told me they would give me the newer 3400+ chip with 1mb of L2 cache and they didn't. They are playing games, advertising 1 thing and replacing it with something of lower value. Keep in mind they wanted me to pay an extra $22 for a total of $223 for an OEM chip and fan. Out of principal I want a refund and I'll purchase my cpu and fan elsewhere.
Why did it take them 9 days after placing my order to get back to me to tell me the product was not available?

First of all, I think that's an older chip, not newer. Secondly, be glad they didn't send you that, because despite the identical model numbers, the 3400+ (2.4 GHz, 512 KB L2) is a better performer than the 3400+ (2.2 GHz, 1 MB L2).

Yes, they are playing games. But you have to accept the fact that these people aren't your local Best Buy. They might not cave to your demands. You've been screwed, sure, but if you shoot too high you'll get nothing back. Try to work with them.
