Help me decide the conditions of a bet

Me and my brother had a bet. The loser of the bet was to buy a CD that both of us were interested in. Should the winner or loser of the bet retain the "original" cd?

It depends. I mean damn how can we know? I'd say the loser keeps original, but then it means he didn't lose as much. The alternative is that the winner wins more if he keeps it. Why not make a copy of it and then just flip a coin to see who gets original? Or better yet snap the original after you've both made copies and then flip a coin to see who gets to kick the other one in the nads.

Well, it was never discussed as part of the bet, and now it's come time to decide who keeps it....the original that is.....since it's already decided as to who the winner is, and both want the original.....

Well the CD that was bought was "Bad Company - What you hear is what you get" a live best-of from 1993.....well, in the last track on the CD, "bad company - bad company" there is a piano, i bet my brother that it was a piano, he claims it was a guitar......after consulting with my friend who is a musician, he says it's a piano, also verified by a tab sheet i found for the song on www.olga.net so he lost since it is in fact a piano..........
