Help Legal advice

Ok so here is the deal..might be long but please read on.

No i went to study abroad for a semester. I didnt know if i would be back or not but thats besides the point. My parnets own a house where i go to college and they rent it out. We got this new guy to take my spot for the year. He signed a year lease agreeing to pay 425 a month. Fastworward to now ...this is what has happend in 3 months of being rent to him.

1. He is a painter apparently and said he wanted to paint the inside of the house. I was fine with this and so was my mom because it looked bad. I don tknow why but my mom agree that he wouldnt have to pay rent for a month if he painted the inside nice and such. Fast forward to now he has done a half ass job, its a mess, and he hasnt paid any rent.

2. My parents told him no smoking in the house...he smoked in my room. They told him to stop..he said ok...he still does.

3. About a month ago my roomates confronted him about something and he put them BOTH in headlocks and through them around.

4. He is like 25 but he keeps calling his roomates kids, and refers to them as kids..like "you know this kids.." H eseriously talks to my parents like he is a 40 year old and knows so much about everything and that he has to take care of the kids.

5. He said he would finish painting and be out by the end of the semester which was last week. its not done nor is he gone.

6. Says he is poor and cant afford anything and yet buys smokes and buys a case all the time.

Ok so its obvious that my parents are very nice people, and firsttime renters. He has taken full advantage of them and that pisses me off greatly. I was about to enter the house when i called my parents before doing so. THey said they just talked to him and he said if they try to tell him to leave before he wants to he will get a lawyer...and we dont want that.

This guy is a dick...and actually i think he is quite crazy. What can we do? I believe in the state of pa the person renting gets almost all the rights...but there must be something.

did he sign any kind of contract or is it all verbal agreements? is the year up yet?

I don't know how big you are, but show up with a baseball bat and tell him he's got two hours to pack his shi[/i]t and leave.

EDIT: WTF? Why was that in quotes?

what does the contract/lease say regarding non-payment and subsequent lease termination???????

you'll probably have to file proper eviction papers as well as give him about a month to move out....

The thing is that my parents are both really nice people. My mom owns her own very succesful retail business which is of course the most hectic right now, and my dad is a working very hard ona promising start up company....which is also very busy right now. while this punk is being a complete dick. He wants to be a lawyer when he graduates and this could explain things lol. He threatend my parents with a lawyer if they tried to do anything

You didn't think it was important to do that before asking for advice as to what rights you have?

Regardless, if he's violating any of the terms of the contract (not paying rent definitely qualifies), then your parents can go to court to get the eviction process started.

Besides, if he can't pay rent, how can he afford a lawywer?

This conversation is worthless with knowledge of the lease he signed.

Trading services for rent is very dangerous since the quality of the service is left up to interpretation.

It is far better to have a contract for rent.

If you want the tenant to perform services then sign a separate contract for that.

PS - Half your arguments are meaningless unless they were discussed in the contract.

depending on your state, you are probably at least 3 months away from getting him out unless you can convince him to leave voluntarily.

Unfortunately for your parents there are laws in place to protect people from wrongful eviction just as there are laws to protect the landlords from parasitic renters.
Now they will have to go through the eviction process (document everything/take a lot of pictures) with or without representation. There really isn't much that an ATOT e-attorney is going to want or be able to do.

Yes i know..i was just trying ti illustrate with some of the points what kind of a dick he is...i understand they are not all legal points. When i get home will ask my parents for the contract and get back to you guys. I also understand that there is on one on ATOT that can do anything....just venting and looking for any advice that is available.

Call the cops, have roommates press charges. Tell smokerboi "Move out now and we'll drop the charges."

Next, convince your parents to sell the property. They're obviously not landlord material.

I dont know jack about legal stuff...can they press charges if it was a month ago? I mean there is no proof...
