There's inherent risk in eating sushi. It IS uncooked fish afterall.

Besides, it could have been something else they ate that day. But, to express his condolences, offer a free dinner for the family.

i assume he has warnings on the menus about eating undercooked meats, fish, etc?

if so he's covered. all the sushi places by me have those warnings

yea...except he had a cooked dish (eel) and a non-fish dish (CA roll)

My uncle has a sushi joint in Sweeden (and they have more restrict food/health laws) and his menu states something in line of "sushi may contain raw fish, which may cause bla bla for certain people" to cover his ass from health regulators... i hope your friend has somethign similar on th emenu...

How do you know that the person ate something earlier (or after the Sushi) and got sick by that?

This would be very hard to prove...

Your 'friends' should really consider if they want to go to court. Their losses could be much higher. It may be easier for them to consult their attorney and perhaps offer a refund, so long as the family signs a letter agreeing not to sue or deflame the business.

Because frivolous lawsuits are rampant, and there's no way to say this family didn't get food poisoning from bacteria that touched what they ate, I would encourage the owners of the restraunt to look into asset protecting what they have to prevent it from being easily taken.

People convince themselves that they got sick off of something they ate even though as noted above, it takes days to appear. When i worked at a pizza place we had someone call about getting sick on a hawiian pizza......errr????? the ham is precooked, not to mention fired up to 400 degrees in the oven.....i refunded his money and told him never to call us again

Request medical record etc i think. Should probably do some stuff to protect urself from being sued. But think of it this way, if they do not sue, then they probably do think that it is ur fault 4 teh food poison. i dont think anyone go through that much trouble for just a free meal.

This is not true. Food poisoning can occur as quick as 15 minutes. It all depends on the microorganism responsible.

As for the pizza example, food poisoning could still occur depending on how the product was handled post-cooking, the true final cook temp (ie the ham no way in hell reaches 400 degrees), and the environment the pizza was placed in prior to delivery.

LOL if i were the restrauranteur i would go to court and make it publicized because there is no way in hell someone gets food poisoning from eel and california roll. it was probably off their dirty bacteria infested dish they ate a home meal from.

They could have easily gotten food poisoning from any of those dishes.
