HDTV wonder: broadcasting flag?

ok, I want to eventually get HDTV on my PC, that may not be for a couple/few years until i get the service. I have heard that starting in 2005, HDTV tuners will be required to support the broadcasting flag which could prevent recording of some TV shows, making TiVo like behavior not work. I was wondering if I should nab an ATI tuner now before the support comes in, or would ATI already build it in? It wouldn't suprise me that they already support it so maybe I should look at another brand tuner?
