Having a party busted by the 5-0

My friend was telling me about a party she was at that had gotten busted. There were over a hundred people that showed up and lots of them were under 21. Apparently when the cops showed up I'm told that they came in without anyone letting them in through the front and back doors. They blocked the exits and forced everyone into a line to get their ticket and wouldn't let anyone leave unless they were 21 or had a ticket. They had breathalyzers, but eventually wouldn't let people use it. They also blocked the exits of the apartment complex. Is this standard procedure? Is there anything one can do in a situation like that (besides obviously not being there) and what are our rights in situations like these?

So if the door is closed and nobody lets them in then they're not allowed in (unless they have a warrant). Is this right?

Or don't be as loud and have all doors shut and windows closed and draped so there's no plain view activity. We could easily fit that many people in our house (with the basement), blast music till the ear drums popped and rake in a healthy profit at $5 per cup. Yet nobody would have bee the wiser if they weren't inside.

We hired bouncers for the front and back porches at $50-100 a pop. No one was allowed outside. And we provided a police scanner. We also hid the profits several times a night.

Eventually we were busted anyway and received a huge fine....which was easily paid for by one night's take.

Usually something along those lines.

The key is to compromise, the cops usually don't want to have to write a bunch of tickets or deal with the paperwork, but at the same time they don't want to look ineffective or have to come back later (really bad, that's usually when the furnishing to a minor tickets come in). Talk to them, find out why they were called, promise to turn the music down, promise to kick people out, etc, at least you'll buy time to flush the booze:beer:

They can't enter unless someone lets them in...or they see something which allows them to (a peek of a bong, someone who looks underage with a bottle, etc...)

Right, plain view stuff. People hanging out on a porch is the easiest way to flag down the police and advertise that you're having a party.

I'm sure that the apartment complex lists in their lease how many people can be in the apartment at a given time. Basically, pay the ticket, take the classes, and do the community service.

If this were a house party the situation would be different on the tactics the cops could use.

fuck that

Talking about piracy is illegal and frowned on by this board. Your attitude shows you are advocating drinking even if under the legal age.

Oh please, there have been whole threads far worse than that comment. Don't be so sensitive.

I don't mind the partys...it's when you all scramble for your cars with a BAC of .10.

I have more problems with hypocrites in my boomer generation telling 18-21 year olds not to drink than I do with 18-21 year olds drinking. If you can join the military, enter contracts, and enjoy every other responsibility that comes with being an adult then you should be legally able to consume alcohol.

If you feel so strongly about this, then write your congressman to get legislature enacted to lower the drinking age.

And yes, my BAN post was a joke. I don't think I've ever cared enough to ask to get someone banned.

That is for 18-21 year olds to organize and do. I just refuse to be a hypocrite and condemn teens for doing exactly the same crap we did as teens.

Thanks a lot for the info guys! I watched the video and read the pdf with a friend. He thought the page with the notice that can be hung on the door was pretty funny so he's hanging it on his door in our hall. Yeah I'm going to stay away from these huge apartment parties. Only ones I've gone to are small ones, but I'll even be more cautious towards those.

Oh I had another question. If a cop smells what seems like marijuana smoke from your house is that reasonable suspicion or probable cause? If its considered probable cause is he allowed to enter your house or does he still need a warrant. What about if he saw a beer can? What if he saw a beer can and it appears like the person opening the door is under 21?
